hello all hope someone can help,
this morning i rang up the bank, as i sent 2nd letter and no reply, it has been 15 days, but instead of going right to mcol i just gave it a try as maybe somthing was soon due to be posted out,
so i ask the kind manto look into it and when he came back on the phon he told that they had "got the letter in question, but it still stands that they have 8 weeks to look into it so i wait untill the start of june or i just take it to court" he said this in a no skin of my nose kinda way, so do i just go right to mcol which i am a bit worried about doing or what?
do you think maybe i have done somthing wrong which they could defend and that i could lose....
any help would be fab

I have recently sent the first letter to Halifax to recoup £3604 in bank charges over the last 6 years, i had a quick response saying that it has passed it over too its investigation team and they SHOULD have a response for me with in 4 weeks but it may take longer. I stated in my letter that they had 14 days to refund the monies or further action may be taken. My question is do i have to wait for the 4 weeks or more or should i press ahead after the 14 days have passed. Any help will be gratefully recieved.0

Stick to you're own timescale not theirs and proceed to the next stageNot Buying it 2015!0

my bank is the Halifax. they charge £39 per bank charge. I have sent my letter to them with my list of charges and amount I wish credited to me stating that I expect this settled within 14 days as per the template. They have replied saying that thay are sorry that I am unhappy and aim to answer within the next 4 weeks when they will write to update their progress. This seems to me to be a 'get out' letter with an unending time process. How do you think I should reply?? Ruth0

I'm in the process of taking the Royal Bank of Scotland to court (sent 2nd template letter 3 weeks ago) and after I telephoned them for an update, they have advised me that they are "investigating my case and that they are legally allowed 8 weeks to deal with my enquiry/claim"?
Has anyone else been told this by their bank and should I wait this l ength of time (i.e 8 weeks) or proceed now with the court letter?
Would appreciate any feedback/advice, thanks.
I have just phoned my bank in the same situation and got the same reply, quoting the FSA. I phoned the FSA helpline and they confirmed that it was correct and that 56 days is the legal requirement. I too am stuck and not sure of what course of action to take!! My next step would be to take it to the small claims court and im unsure if breaching the FSA rules would work against me as I want to do this by the book!0 -
I got my statements back from TSB,have sent off the letter, got a letter back saying they were in the right basically, iam trying to get through to the customer care and have no luck, when i did get through to another line, they said it would be better to write a letter, saying that i didnt agree and want my money back, does this seem ok,and how long will that take ?thanks for any help or advice.0

I have decided to send this letter to their letter saying that they will take 4 weeks to send un update of their progress to allow them to fully investigate.
nb
I also found that although it costs more special delivery got an answer in 4 days as opposed to a first class stamp which took 4 weeks for a response
I intend my next letter to be the same as below and ask for interest
this is all unpleasant but I have worked out that the sum owed to me is over £1000
Thank you for last letter of 24th April, 2007.
I appreciate your thoughts of concern but would remind you that I requested that this matter was settled within 14 days from the date of receipt of my letter which was dated 20th April, 2007 and I would be glad if you would keep to the requested dates.
Please send confirmation of receipt of this letter and your intentions of compliance to my request. Alternatively, please send a date by which you will settle my request in full.0 -
Even if the Financial Services Act specifies a timescale, it should say something like "up to" whatever it is. Even if the Act gives them up to 8 weeks, you are giving them up to 2. As 2 is less than 8, you are just ensuring that they comply with the Act.The acquisition of wealth is no longer the driving force in my life.0
