Anyone out there help on this - I have sent my first letter to bank with list of charges and received a letter today saying that they are looking into it and aim to resolve the matter by 25 May 2007.
Do I wait until then or do the 2nd letter ?0 -

Hi,
I filed for a refund of my bank charges 4 weeks ago with Smile, the Internet bank.
I sent them a message a couple of days ago reminding them, but they have replied claiming that they actually have 8 weeks to reply to a claim (I think they quoted the FSA on this).
Is this true, or do you think I am being given the runaround here?

If you followed their complaints procedure, then yes. But you are not, so follow the steps in Martin's article and take them to court.Reclaimed thanks to this site:

The FSA guidelines (which are not the law of the land) probably gives them up to 8 weeks to reply. The guidelines almost certainly don't say that they can sit around for 7 weeks and then send a standard letter. So, as 2 weeks is less than 8 weeks, you are just doing them a favour by ensuring that your claim is replied to well within the FSA guidelines! Keep to your timetable - its your claim not theirs. I used to deal with customer complaints for BT, and we used every trick in the book to delay and/or make customers "jump through hoops" as we called it, even when we knew that their case was legitimate. If you set a deadline, keep to it to the day - I can assure you that sort of thing is noticed.The acquisition of wealth is no longer the driving force in my life.0

I spoke to the coop bank on friday regarding my claim for a refund . I told the woman i spoke to that as i'd already sent 2 letters regarding my claim and given them over 28 days to resolve , i would now be starting legal procedure .
She basically said that they have 8 weeks to resolve my complaint according to FSA guidelines and i wouldnt get a refund until the end of the 8 weeks .
So it seems as though the banks are using this 8 week guideline thing as a delaying tactic .
My advice would be stick to your timetable for reclaiming your money .Put it this way , if you owed your bank money would they give you 8 weeks to refund it to them ?????????0 -
hi all,
just thought i'd share this with everyone i am claiming from lloyds
and following my timescale set by martin and i am currently in the court process they agknowledged last week so they have one more week to defend
however a friend of mine has followed there timescale and after about 7 weeks (of the 8 they give her) she has just received an offer of £3,500 (she was claiming £4,000 ) then 2 days later they sent her an offer for her 2nd account (which she did'nt even claim for) for £650 so shes got a big smile on her face while i'm still waiting so maybe its not such a delay tactic......0 -
I have just been onto my bank again as their time is nearly up for me to now start the ball rolling for a court summons!
I have been told that they have 8 weeks as stated by the ssr? or something?

apparnently they recieved my first letter 3rd april so they therefore have till 29th may to decide what to do?

I sent the Reclaim Bank Charges letter (using Template from this site) to the Halifax on 10th April 2007 (letter sent recorded delivery). I received a "holding letter" on 16th April.
The response from the bank was that they were looking into the issue but that it would take up to 8 weeks to investigate. It also said that they would update me within 4 weeks.
My question is ... I gave the bank 14 days to respond (as per the template). The Halifax have sent me a response - not a decision. Should I now send the 2nd letter giving 14 days before proceeding with Court action, or should I wait the full 8 weeks before taking any further action.
