Hi forum.
I'm about to send the third letter (asking again more firmly for my money otherwise I will take them to court) and I spoke to someone at F.O. who told me that I need to give the banks 8 weeks from the day I first wrote to them asking for the money...looking at the letter templates it seems to be a lot less than this....I don't want to give any potential legal advisory panel a technicality to delay or defend their position so do I need to wait 8 weeks or after the 14 days as per letter three, can I on the 15th day start the money claim claim?

I recently received letters from both Capital One and MBNA saying they need another four weeks or possibly longer to look into my situation. Is this standard practice from them? should I wait or send them another letter?

Having sent HSBC a letter asking for £1,200 in charges at the end of March, I received a letter a mere week later saying they were 'looking into the matter'. Their letter was dated March 31. Six weeks on, having heard nothing, I'm not sure what to do next. Shall I give them a bit longer to complete their 'investigations', or should I fire off another letter threatening court action?
I'm sure this enquiry has been asked before, but having scoured the forum for the best part of an hour, I couldn't find anything comparable. Sorry.

Oops, their letter was in fact dated April 11, not March 31. Apologies for that. The query still applies tho', and any advice will br greatly appreciated.0

I'm completely new at this but hope someone can help
I followed the prompts and sent my letters to HSBC we've got 3 accounts, totalling around £4500 - they sent statements for 2 accounts but I went on-line and got the 3rd accounts details. I sent 2nd letter off asking for money - no reply - so I carried on sent the letter threatening court action - and they responded within a week saying they acknowlege the letter and are looking into it??? That was 10 days ago - What does this mean?
Have they replied within the 14 days as the letter has stated?
Should I just carry on and set a court date?0 -
Hi once they have responeded it can take a few weeks to get an offer - i would carry on with court action, but hopefully it wont go that far, i did the same but kept on at my bank with phone calls and eventually got my full settlement without it going to court .... good luck0

From what I've read on this site, HSBC tend to settle within about 8 weeks, however, if you make a claim against them, they tend to wait until the death and then cough up. Entirely up to you whether you give them the extra time or proceed with the claim. Good luck either way:dance: Proud to be dealing with my debts0

Hi Everyone
We have just wrote letter 2 to Barclays and have given them 14 days to respond. We recieved a very polite letter the weekend stating that they need a further 4 weeks to look into our complaint to fully investigate it, they also state if they cannot do it in 4 weeks they will let us know and give us a full report in 8 weeks. Has anyone else had this? Is this a typical stalling method? Do you think we should now continue to letter 3 taking court action?
Any advice would be great. Thankyou and good luck to all in the same position as us0 -
This is a mixture of typical stalling and the misunderstanding of the banks. Many of them think they have 8 weeks to deal with a complain before it goes to the Financial Ombudsman.
As your complaint is based on a matter of law you aren't bound by the 8 week rule.
Stick with the deadlines you have given, not theirs.
The rule of thumb is to not make threats you aren't going to follow through with. If you threaten them that you will take it to court then be prepared to take it to court. The time for easy payouts has gone unfortunately as there are just too many people doing it now.Hamsters have no tact and diplomacy, nor do they want any.0
