Have the banks got 8 weeks to reply?!!!

    I fired off my first letter on March 15th - I have caqlled them twice regarding this and have been advised by them that the FSA have given the 8 weeks to reply!.. I have also been assurd that my letter will be dealt with my May 10th. I am putting together a claim on MCOL for this friday if i do not hear anything. I sugget you read some of the success stories on here re HSBC !!

    My claim: £4,538 (this included interest)
    Offered Friday 4th May: £3,300[/B]

    I had the same respone as you, I had a letter early on saying they were looking into the matter although I had asked for a response in 14 days, and everytime I called the customer service line I was informed that the FSA had set a a response time of 8 weeks and that they were adhearing to this.

    So I waited, however, on my final call last week they mysteriously didn't mention this and said nothing had been done to my claim. As were at the magical 8 week mark (according to HSBC), I sent the 2nd of Martin's letter's which I amended slightly saying I had asked for a response in 14 days, they had not responded to my satisfaction in 58 days and that they had 7 days in which to respond, or I would start court proceedings. I had a reply within 2 or 3 days offering £3,300 (lower amount as they didn't recognise interest).

    Try a 2nd letter first - you may not have to start the court proceedings.

    I am not sure whether to settle or push for Interest - can anyone help me with that one?

    i recently sent my bank a letter about reclaiming my bank charges and they have sent me a letter back saying they are looking into the matter can anyone tell me roughly how long it is before they actually get back to you. it's probably been about four weeks since i recieved the letter,any help on this would be greatly appreciated.

    Hi BFC,
    It varies from bank to bank, but the common theme is....stick to your own timescales. If you have given them 14 days to reply and they haven't, move on to the next step. The longer you leave it, the longer they will take about getting back to you. Good Luck

    i sent letter away two weeks ago and still not heard anything, bank told me it would be 40 days! do i wait or give them the extra days before i send second letter?

    Are you sure they're not talking about the statments, because that is 40 days? If it's the letter you've sent detailing the charges and asking for your money back, the general advice throughout the site is to stick to your own timescales. A lot of it depends on your own circumstances for example, are you in a position to pay out for the court costs? If not, it may suit you to wait a bit longer. Good Luck

    Started a new thread as kind of a general question as opposed to just linked to Barclays who my claim is with

    Quick update for those that havent seen whats going on in the Barclays thread at the moment re my claim
    14 days ago i sent the 'unsatisfactory responce' letter to Barclays stating that i would start court proceedings in 14 days
    Today its up so i thought i would just call them to see if they had an update before i started

    Barclays told me that as per the Financial Regulatory authority they have a maximum of 8 weeks to reply back
    This gives it another 2 weeks today !!!

    Is this correct ? i dont want to start court proceedings and mess it all up as they didnt have this '8 week allowance' to reply to me, then i would prefer to wait a further 2 more weeks...

    Is this across all banks or just Barclays ?
    Or is this just another delaying tactic ?

    In reclaiming charges you are viewed by the bank as having made a complaint and have been entered into their procedure for this along with the relevant timescales for dealing with such. All banks are allowed 8 weeks to deal with a customers complaint according to regulations laid down by the FSA. If you intend to take this matter to the Financial Ombudsman you need to have allowed them this time before the FO would take up the case.

    If you intend to use the courts then the 8 week time period is irrelevant. The timescales laid out in the templates are designed to show the judge that you have given the banks ample oppertunity to settle your claim before bringing it before the courts to be dealt with.

    You dont need to wait if you intend to bring the claim before a court and can proceed now. Good luck :)
