Have the banks got 8 weeks to reply?!!!

  • Hi, I'm new to this and need a little advice. I recently claim my charges from RBS and everything was over and done within 3 weeks which was great but I'm now doing the same with Halifax. They are digging in and saying it will take 8 weeks to deal with my complaint. Is this right? or do I stick to my time line of 14 days as they have stated in there letter they have 8 weeks to deal with this query.

    I'm unsure what to do. Has anyone out there come across this with Halifax and if so how did you proceed?

    I'm also having delay tatics with the Halifax credit card.

    I would be very grateful any advice as they have treated me pretty badly in the past.

  • Im having the same as you. 40 days etc and they wont budge. Its driving me mad and I dont know what to do either!!:mad:
  • I've heard a rumour they are waiting for the new rules to be set so they can get away with not paying but I'm assuming that because we got our letters in now they will still stand if we go to court. They are a nightmare.

    We sent our letter with what we are claiming and today got this reply..

    Thankyou for your recent letter regarding charges applied to your account.

    We are currently considering your claim and will respond to you as soon as possible

    Did you specify a deadline for them to reply?

    If you did, wait until that deadline has passed and write again threatening legal action.

  • I am having the same problem too, I am going to ring them tomorrow as i had given them a 14 day reply time and that was 28 days ago. However in their last letter to me they said i had 8 weeks to respond so i don't know how i stand.
  • Hi, I'm new to this too! i sent my first letter at end of march and had a reply just within the 14 day deadline saying they were looking into it and it would take 8 weeks. i then sent a second letter giving them further 14 days before commencing court proceedings. as i hadn't heard i rang yesterday and was basically told they're entitled to 8weeks and i would hear something then. i'm not sure what to do either? i feel like they would not allow it to go to court but feel scared about setting the court wheels in motion.#
    this is the HSBC and i'm claiming £333.00!! any ideas???

    They replied with 7 days but how long do we sit until they ''consider''???

    The 8 weeks that the banks mention is the time limit they are given by the FO to deal with a complaint and this is a standard letter they are sending out along with the leaflet from the FO as they are obliged to do.

    Stick to your timetable of 14 days and send off your next letter at the appropriate time as in the step by step guide in Martin's article below.

    Follow your timescale, send out your next letter on day 15 if you haven't had a reply or you have had their standard "looking into your complaint" letter.

    If you have sent both letters without a satisfactory reply then its time to start your court action, however do check out your bank's thread to see how they are currently dealing with complaints.

    If you are having problems getting your statements/information please read this thread, this is the only time that 40 days comes into play.
