  • Well today i got a letter from halifax charging me £88 for going £2 over my limit. It was charged at this much as a payment I authorised was put through as 2 transcations. I payed £12.50 for some goods at a Virgin Vie party, this was put through as £12 (£30charge) and 50p (£30 charge and 328 for going over limit) for some reason. Halifax say i have to claim the money off VirginVie. Not sure who is at fault really, I have my receipt to prove I paid £12.50 but Halifax aren't intrested as I have claimed my charges from them once before. I wish the Oft would hurry with the test case so i can claim back what they have charged me since May (£400:mad: ) and close my account with them once and for all!
    Help, who do I chase???

  • Hi, sorry if this has been discussed elsewhere, but I'm just after an answer specific to me as I'm a bit skint at the minute, and the money I'm owed would help a lot. I'm also very simple when it comes to bank accounts and don't know much about them, to be honest.

    Anyway, I'm with Halifax. I've received 3 bank charges in the past couple of months. 2 £30 charges for going £2 and £3 over my arranged £100 overdraft. Thing is, when I went over the overdraft, I put the money back in a couple of days later. I then received another £28 bank charge on 31st August, but I'm not sure what that was for.

    I've been with Halifax since my 16th birthday (so 3 years now) and this is the first time I've gone overdrawn. I've got a cash card account, current account (the one with the overdraft) an ISA and a credit card with them. So I'd say I was a pretty loyal customer.

    I sent them that letter asking them to reimburse me with the bank charges I paid but they sent me back a letter basically just saying "No."

    Is there anything I can do about this? I requested the bank charges back a couple of days after the court case was announced. Any letters I can send off to make Halifax feel guilty about taking a poor 19 year old's beer money?

  • After reading about the Test court case and other threads on here I have received a letter from the halifax that my claim is on hold until after the test court case, The have said I can still take it to FOS or court but the will but it on hold also.

    So SHOULD I still go ahead or wait for the outcome?

    Please advise.

  • I was awarded judgement on the 31st July 07 and am still awaiting payment of charges from the Halifax, i have rang a number of times and they keep telling me they haven't recived the judgement. i have also been told due to the test case any case's won are now put on hold !!!! this cannot be correct can it ? on another phone call last week i was told it is being dealt with and payment will be made within 5 working days, i have rang again to chase it and have been advised halifax have not recieved the judgement !!! just total lies & terrible customer service. i have issued a warrent and this has been returned unfullfiled as the halifax operates from a PO box no. & not an address. Does anyone have any ideas or comments of what i can do next?

  • If judgement has been passed they have to pay - that simple. There must be an 'actual' address for Halifax head office (isnt trinity house one?)

    You have been awarded judgement - they have to pay - simple as that. They refuse or dont pay then you take them back to court.

    If you go to the Halifax website you shjould find there registered office address which I believe is Trinity Road in Halifax re-issue the warrant for the Head Office address which technically is the address you should have used on your claim form.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Have a read of Martin's Emergency Guide as to your options now. If you have a lot of older charges then you really need to file your claim at court or these older charges may be time barred by the time the test case is over.

    I bank with the Halifax, I requested the fee amounts and they have sent 6 years of statements rather than a figure. They also notified me that they do not charge the £10 DPA fee for this information and did not cash the cheque I sent.

    The thing is, I know I have charges against me. Everytime a Direct Debit has failed I have been charged £39 per DD. However, they don't stand out on the statements. Is there something in particular I am looking for? Do they word these charges in a different way?

    Any help would be great. TIA
  • When i looked at my statements the charge for returned direct debits (and other charges) was shown as "account maintenance fee". Hope this helps.
