  • sometimes things happen that are out of your control..

    i was VERY badly injured in a motorbike accident and was laid up for months (broken neck/basal fracture (skull fracture)/three crushed vertebrae/ broken foot in two places/nose in 4 /nerve damage in eye/hand/face etc etc etc etc etc etc)

    month after that my father died necessitating expensive and multiple trips home (im not from the UK)

    its taken me a year to get back on my feet financially...never mind physically

    ive alreayd gotten my statemetns through and done the calculation thing...

    the thing i was miffed about was they could have had my statments out to me in a week, giving me time to get my claim in before the freeze, but the ychose to fob me off for 40 days, till the freeze came into effect THEN sent out my statments with the freeze notification..

    Well apparently you can request that your claim be dealt with despite whats happened recently if you can prove you are experiencing hardship and financial difficulties, And since hubby just lost his job and things are going down hill fast for us I can give them as many financial diffculties as they want.

    So I just put a note on the bottom of my normal claim letter saying I wanted the claim dealt claiming hardship. I dont know whether or not it will work but its worth a go.

  • Personally I think the bank charges were justified as they were clearly listed when you signed up for the account - and you didnt maintain your account in order. But the manjority of people here disagree with me - but we'll leave that for another time.

    Not when I signed up to my bank 20 years ago. at the 35 quid then I would of laughed all the way to the door

    Having read a few other posts on other forums it looks this is a standard letter being sent out by a few banks after the publication of the FSA direction on how they should deal with customers while the test case is on.

    The payment they made to me which I accepted without prejudice and told them as much in a letter which also explained that I would be claiming the remainder through the courts was made well before the 27th July which is when the FSA direction came into force.

    I am presuming quite correctly I think that payments made and accepted before this date cannot be included in the direction.

    What I mean by this is that after 2 months when they assume I've rejected their offer they can't take their money back.

    My wife has just received her charges list from Halifax. She has quite a lot from the end of 2001 onwards (ie nearly 6 years old).

    In Martin's article, he says to start the claim, so I have printed out the 1st template letter, and the schedule of charges (and interest).

    If I send this in, what's my next step? I know what it normally is, as I have successfully claimed my money back from LloydsTSB - even going to court. But what happens now with the test case etc?

    The same rules and steps apply, only that your bank will be even more unhelpful as usual and your court claim might be stayed. But it is important to get your claim in the system to avoid getting time-barred.

    Hi Peter, I have just had the very same letter from Halifax. Do I proceed and claim or wait and see what happens?

    Before I went on holiday in July a friend of mine received a cheque for £1367 for her bank charges from last 6 years, she said it all ran smoothly and even emailed me a copy of the letter she used. I said I would do it all after my holidays!!! Then when I have received Martins money tips email it says that it's all been stopped for the time being. I am so mad with myself I never did it before I went. What do I do now?

    Do I just forget it or do I still send my letter and then I am in the queue? If I did send it now would the 6 years go from now? I am quite confused about it all now and just dont know what to do. Really kicking myself. I bank with Halifax by the way.
