    I'm feeling the same stress as I had £350 worth of charges last month on my Barclays account and now they have cancelled all my directs debits. Now some of the credit card companies whose direct debit hasn't been paid are charging me too!

    I'm now going to claim all my cc charges. Does anyone know what MCOL is?

    it is a disgrace the oft can announce the test case and suspend all claims after pressure from the banks.they did not have the bottle to tell the banks to stop charging until after the test case did they?
  • hey folks!!!

    went into my local Halifax branch a few weeks ago, asked them to send out my statements to commence bank charge reclaim procedure...

    waited about two weeks and got a letter from them saying something to the fact they had such heavy volumes of pelpel trying to get their statements id have to wait 40 days for mine...

    (its not as if the printer had run out of paper now or they write the things out by hand, eh)

    waited another few weeks and got a letter (including my bank charges listed) saying they couldnt proceed with my refund as they had entered into this 'stay of execution' thing with OFT and OFCOM

    it REALLY looks like they simply delayed me till they had gotten the freeze..

    should i lodge a complaint?

    it seems very underhanded to me...

    any advice would be appreciated as the 2k+ get back would really get me back on my feet regardsing a few debts...

    if i should (i think i will) who should i approach, or is there a preferred procedure or way of expediting things?

  • its a shame that what would be considered underhand and sly if it were dealings between individuals is ok by the letter fo the law...

    I am in exactly the same position with Halifax - waited the 40 days and got my copy of the charges back along with a 'dont bother' letter. I am in the middle of writing my letter out and am going to claim the financial hardship. Either way you should get your claim in.

    hey there!

    how do you mean claim the financial hardship? that some 'angle of attack' or do ya mean you're going to proceed with the standard application for the refund?

    im in the process of filing for my charges anyway...

    itd be interesting if they got a group complaint against them...

    mayber geta few of us together if there are enough on here in the same position..?

    Personally I think the bank charges were justified as they were clearly listed when you signed up for the account - and you didnt maintain your account in order. But the manjority of people here disagree with me - but we'll leave that for another time.

    The bank has seen that it has a chance to wait for the test case to go through before handing out its money to you (or your money back if you prefer). Why not ?

    It was a similar case with the speeding fine case and everything was on hold until the test case was sorted out.

    Nothing is stopping you from getting your statements and beginning to claim back your charges and filing your own case. They have just informed you that the refunds will not be processed until the test case is complete - which in itself is completely reasonable.

    So continue with the normal procedure, send out all the letters, start legal proceedings. Once those are in place, you will have to wait for the test case to go through before your final decision is made.
