Hi
wondering what to do next i sent the letter stating that i would take them to court and a few days later 50% of my claim was paid into my account as cash a few days later received a letter stating that this offer was a goodwill gesture and that i can accept or reject this offer i have two months, by signing and returning the letter the settlement if i accept this offer will be full and final settlement of my complaint. So what do i do now ????if i don't respond then they will assume i have rejected the offer and wait for the outcome with oft.0 -
I wrote off to the halifax 40 days ago asking for a copy of my bank charges, I got them this morning and its a total of 1658 - far more than I thought.
But the letter from them says basically forget claiming after the recent events. Is it worth taking it further and claiming or should I just forget it ?Total 2019: £3972 - Best win this year £3000
2018 total £4062/2017 total £2260/ 2016 total £2025/ 2015 total £3809.0 -
I've also had one of those standard letters they're sending out. I accepted a partial payment a couple of months ago and wrote to them to say that while I was happy to accept the payment without prejudice I would be seeking to claim the remainder via the court process which I have done. Halifax have acknowledged the claim and have said they will defend it. We'll see what happens next.
The interesting thing aboout the letter is that it if I decide to reject the offer pending the test case I will need to give them their "goodwill gesture" back. Hang on, if a "goodwill gesture" bore no connection to the claim when I made it, how come it does now.
They also give it the usual "full and final settlement" garbage saying that if the "goodwill gesture" is accepted and I quote
"This means that it is unlikely that you would be awarded a further sum even if the test case indicated that you could be entitled to a potentially larger amount."
You have to admire their arrogance. What they're saying is that if we (Halifax) lose and it is proved that we've been ripping you off for years then we still wouldn't want to give you any more money.
They continue "though this does not preclude you asking for repayment of any future charges if the court finds they are unlawful". Ahh bless them.
They can go and as they say "sit on a stick".0 -
Well it's now nearly 2 weeks since I accepted 2 offers from BOS and still no funds in account, or cheque for the closed account. Kinda expected it as the FOS advised it would be within 6 weeks. Going on past experience with the claim, they will be taking it to the wire, probably get paid out mid September!!

I was told on monday that it would be 48 hours hopefully, phoned yesterday to be told it was pending but couldnt tell me when it would be through!
Im getting annoyed now after being so happy on monday and money would be really helpful just now lol

As my post above says, I have been waiting 2 weeks now. I can't really complain, as the FOS did say 6 weeks. I phoned regarding my personal account and used the excuse that as the account was now closed, how would they pay me. The guy asked me when the acceptance was sent in and said that once it is processed, it takes five or six days for payment to go into account or cheque to be issued. He said I should probably receive a cheque about mid to end of next week. I'll then have to wait another week for cheque to clear! Spent the last 2 weekends looking at cars and organising a trade in. Ah well I think I'd be as well to wait, as knowing the BOS it could be another month or so and all the cars I've looked at will be well gone by then.
