    HI any help appreciated.
    claiming back just over £500 from bank
    offered me £253 as goodwill gesture
    sent letter recorded delivery on 26 june saying that i was refusing offer and wanted full amount. I also mentioned in letter that i was reclaiming due to all charges were taken from benefit money.
    letter was signed for 27 june at bank
    and still not heard anything back from them!:mad:

    now with all this test case talk im confused as 2 whether they are not dealing with me coz they are suspending all cases til this is decided.
    Should I phone my bank and explain that mine is not a new case?
    I was going to go down the fos route but they have stopped new cases as well

    For those who haven't start court action and have been told their case is now on hold, you must actually start court action now or your early charges from 2001 will be time barred if you leave it until the test case in finished.

    If anyone has an upcoming court date then you must prepare for this going ahead, it depends on your local court if this will go ahead or not.

    For anyone in financial hardship and/or having charges taken from their benefits then you can ask the FO if they will take on your case. Please see the Main Banks Thread for links to these threads.
  • i am currently banking with halifax and i am a part time working student. halifax have over charged me by £10 over the standard charge rate of £20 for students every time i have been charged. i have contacted my bank and they said that they feel i have been fairly charged. due to the "test case" currently going on am i still able to claim these charges back, the claim was in motion (paperwork, not in court as of yet) before the "test case" came to light.

    Hi there,

    It certainly sounds as if you "have the right" to reclaim your bank charges ... £20 sounds a lot to me, let alone £30rolleyes.gif

    Halifax are not one of the bank's involved in the test case, so it's a bit of a grey area and totally up to the courts as to whether you are able to proceed at this point or not.

    Halifax are included under HBOS.....

    The banks that will be a party to the case are: Abbey National plc, Barclays Bank plc, Clydesdale Bank plc, HBOS plc (includes Halifax and Bank of Scotland) , HSBC Bank plc, Lloyds TSB Bank plc, Royal Bank of Scotland Group plc (includes Natwest) and Nationwide Building Society.

    due to the "test case" goin on at the moment, am i still entitled to claim back my bank charges?? i am a student and have been charged at least £10 and more extra on top of the standard amount that is applied to student charges! i am currently banking with halifax plc.

    i started to get the ball rolling with my "claim" approximatly a month ago (not yet brought forward to court). is it advisable to still go ahead as it was started before the "test case" was brought to light??

    any help or information would be much appreciated and thank anyone to do so in advance.

    I am new to this forum lark so I appologise in advance if I've posted this in the wrong place!

    I have been trying to reclaim my bank charges from 2 separate accounts with 2 different banks. One (RBS) paid up the full amount, no problems when I sent the 2nd letter. However the 2nd (Halifax) is giving me nothing but problems.

    I sent letter 1 on 08/02/07 and got the statements. I sent letter 2 requesting the charges be refunded on the 16/02/07 and recieved the standard "your responsibility" letter, so I sent letter 3 on 27/03/07 threatening court action.

    However as a single mother I have been unable to find the spare cash to lodge the court papers.

    I have had a couple more charges added since then, the latest of which has made my blood boil... I realized that I would not have enough money in my account to cover all my direct debits so my daughter lent me the money and paid it into my account the morning they were due, the bank haven't paid it and are slapping a £39 charge on. I have rang them and they said that the money has to be in the account the day BEFORE the DD's are due so the charge will stand!!!

    Can I add the charges added to my account since letter 3 to the claim? Has anyone any idea what I should do now?

    What makes all this worse is that my daughter and future daughter in law both work for the Halifax!!
