Well i'm a little stumped please help !!!!!

My out of court settlement was £3800, of which i have received £1500 in advance.

Whats worrying me is the balance was due in 'FIVE DAYS' from me acknowledging thier offer and guess what ? yes the five days has passed

Now what do i do ?, the County Court know that i have settled on a figure but still confirmed the case will not be closed until payment is recieved in full.

Do i give them a ring to gently remind them ? or do i lay low and hope the money turns up ?

    PLEASE ADVISE ME :o

Just to confirm the offer letter is dated the 23rd of JULY, well before the announcement date.

I am claiming the best part of £4000 for the Halifax. I have just received a letter dated 25th July offering £1780 as a 'gesture of goodwill' and in full and final settlement.

Obviously this letter was dated before events on Friday 27th.

    Any advice please?
I think you have so long to accept your offer. Also I'm sure you can accept this as partial payment and advise them that you will be going for the rest, once a decision has been made on the test case.

  • HBOS sent me an offer of £212 when I asked for £608.
I prob going to accept it as I don't have the patiance to wait a year or more - I'd have lost all the paperwork I've sent them etc.

Thing is, they said if I don't accept then I've to send them the money back.
Is it not their responsibility to take it off me?

Can I send them a letter saying I do not accept this as full payment of my claim, but not send them the money back.

Then if the court case goes against them I can claim the rest?
  • Hope I am doing this right as I have not posted before. Have had an amount paid into my account by Halifax (about a third of my claim) but NO letter of offer. Spoke to person at the bank who said I should have had a letter and that she would send me a copy (none received so far - about 5 days after my phone call). She told me everything was now on hold and that I must accept their offer (what offer? I have just had my account credited!) or send the money back. As I actually have not had an offer can anyone advise me please how to word a letter to them so that I can keep the money I have received ligitimately and still claim the balance I have claimed.

Also I received a partial offer from HSBC which I turned down but stated that I would like them to increase their offer to something less than I had originally claimed but more than they offered me. 2 weeks have passed and I have not heard from them at all. What should I do now ( my original offer deadline had passed). Sorry to go on but I had been doing really well until this latest development and now I am very :confused::confused::confused::confused:

  • Hi

I recently rang halifax to get a bank charge reclaimed has I noticed £30 had gone out of my account for going over my overdraft.

When I rang them I told them my situation and they agreed to reverse the charge as good will? Well once again I have been charged £60 for apparently going over my overdraft on 2 seperate occasions on the same day.

I rang them again asking them what is going on and they told me they reversed some charges for me THREE times in the same day when I first rang them (which I was unaware of).

Now they say they can not reverse this further charge as they have already done it for me once, is this right what they are telling me?

If I can not get this reversed, who am I supposed to contact about it to claim it back and does anyone have any idea how long this process will take?

My bank is halifax and I have noticed my online statement is often wrong about what is in my bank and what is going out, like it wont appear for days later etc.

If anyone can help me or give me any advice that will be much appreciated, thank you.
  • My claim was in the MCOL system when the OFT test case was announced. <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" /><st1:City><st1:place>Halifax</st1:place></st1:City> had until 30th July to acknowledge, just 2 working days after the OFT announcement. No defence was filed so I asked the court to enter judgement, this was passed and <st1:City><st1:place>Halifax</st1:place></st1:City> were sent a order to pay immediately. Almost a week later and I haven't received my claim or heard anything from <st1:City><st1:place>Halifax</st1:place></st1:City>. I'm unsure how long I should give them to pay up or if I should send in the Bailiffs. With all the confusion at the moment I am still unsure if I will definitely receive my claim and don't want to spend more money on a warrant. Any suggestions/ advice?<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>
