    Hi,

    I received a refund of my bank charges back in July but since the OFT proceeding I have had a letter from Halifax asking if I still want to accept this offer and agree that this will be in full and final settlement or decline the offer, return the money and wait for the outcome of the OFT case. I'm a little confused as later in the letter it states that Halifax "are sorry that we have not been able to respond in full to your complaint". I might be being slightly dumb because I thought that receiving the money was responding in full??

    Please help as I don't know what to do!!!

    They ar getting you over a barrel,

    a) you have probably spent the cash and if you say no to full and final will owe them.

    b) If you accept their terms and sign to state that , they will through that at you if you ever claim again.

    You have rights, and might feel the need to claim again.

    If it was me you have 8 weeks to respond i presume? i would leave it to the last minute and see how things pan out over the next few months as things change daily.

    I wouldnt lose sleep over this its the bank covering there back and probably feel their first offer letter didnt cover them enough.

    It may just be a case of the Halifax trying to get some money back from its customers.

    They have been happy to pay you out they cant just change the rules. Tell them tough you've spent the money and if they continue to send those letters to you, you complain to the banking ombudsman.

    That should shut them up
  • Help! I claimed my bank charges back in March. I have now received another bank charge for £39.00 which is going to be taken from my bank on the 13th August. I can not pay the charge, and its way too high. I am with the Halifax. What do I do now? Write a letter?

    Personally I would phone the bank and just see if they will reduce the charge as a goodwill gesture, they are probably more likely to do this in a conversation than by letter. Another reason for phoning is that you don't have time to negotiate by letter anyway, you need to stop the charge going through otherwise it is likely that if this charge causes you to go overdrawn again that this will just roll on and make a charge next month etc..which is how it all starts to snowball. However I don't know if having previously reclaimed your charges will have any impact on their decision of whether to write these off or not.

    If they will not write this charge off than I would strongly urge you to borrow the money from somewhere to pay it, otherwise as per my first paragraph it will just spiral and you'll end up with monthly charges again. If you can deal with this straight away, you can then deal with reclaiming the charge later..maybe read the other threads about the current state of affairs re claims..but get the charge cancelled, reduced or paid first.

    This seems to be a standard letter that Halifax are sending out to all reclaimers at the moment even if they have had their money.

    Ring them up & in future make sure you send any letters signed for, that way they cant deny getting it.

    It is possible that they have a huge back log though so try give them a call, if you get no joy then send a letter

    I dropped in some time ago, following the leads from you other readers regarding Halifax Bank of Scotland refusing all claims in the first instance, and advising of the telephone number to use.

    Well of course since then HBOS have joined in the test case and are refusing to answer any more complaints until the outcome of that has been heard.

    I suppose you could say I was one of the lucky ones, I asked for £555 and they offered me £277, around half of course, the money goes into the bank without you even saying yes or no, you have to physically pay them it back if you want to negotiate- cheeky! anyway we decided it was money we had never had and something was always better than nothing.

    Then following the news about the test case, we have recieved a letter saying that we can refuse the money etc and wait for a better outcome or we can accept it and sign the form to say no further action will be taken against them on this complaint. We have until October to complete this form and send it back. The letter itself is very pleasant and says that you could recieve a better offer if you hang on but also points out, you could receive a lower offer too.

    Just thought I would let people know what HBOS is doing with these complaints, the whole process was quite timely as we originally wrote to them in April and only recieved a payout in July. However it is in itself still a success as we have the money in the bank.

    Of course it came with no admission of guilt and full and final payment etc, however this will not stop me putting a claim in for my other accounts with them when the decision has been made following the test case.

    I received my letter this morning, and it is going on about the claim process is on hold or something because of the OFT?

    What do i do now? do i just wait or what?
