  • Before the court\oft announcement, I recieved an offer of £595 from Halifax, I called them and re-negotiated £895. They promised cheque would be sent. I called them back twice after the court decision happened and they confirmed the agreement of £895 still stood and cheque was due.

    Shock....the cheque came but for £595. I called them and they denyed their were any notes for £895 on system, I asked for a manager to call me on friday and they didnt.

    I called OFT who were less then helpful and basically suggested "just take it" as full settlement or wait around 2 years.

    What should I do??

    I would write them a letter saying that as they have not paid you the settlement figure as agreed you are taking this as a repudiation of the settlement agreement and will be commencing legal action for the full amount of the outstanding charges and in the meantime are taking the £595 as part payment of the sums due.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    could i then take then to court of the full amount i had originally offered to accept? The total with interest came to £2341, I offered orignally to accept £2000, then this court action happened so knew i was better to at least accept £895 as part payment

    You would be entitled to claim the interest as well.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

  • Can anyone tell me the next step? I have requested lists of bank charges using Martins' letter templates, but Halifax are ignoring me! I have had no acknowledgement from them so I don't know what to do now. What do I do now? I have telephoned once and written three times, surely that should be enough?

  • :mad: Hi There. Recently Halifax bank took a £39 charge from our account resulting in 3 small payments amounting to less than £20 failing. They then took a £117 charge from our account. When we rang, they said that they had reversed charges in the past and are no longer willing to do so. I put in a letter of complaint that hasn't been answered 2 weeks later so i rang them up again today and they said that due to the current 'test case', there is nothing the Halifax or any other bank can do to reverse charges now and basically fobbed me off. Due to the £117 charge now another direct debit failed by a matter of a few pounds and another £39 is being taken on Wednesday taking us overdrawn till i get paid on Friday. This new test case has given the banks carte blanche to do what they want for the time being and its us that struggle. What can we do?? This has caused so much stress in our house. :mad:
