well, i'd still proceed with it,as per normal but, maybe bare in mind you will probabally have to either take them to court or wait til fingers crossed the OFT win or there is some other loop hole,where we can get around the stay. yes, your claim will go from six years backward of you putting in your claim.so the sooner the better. follow martins steps ,and try not to get charged anymore in the meantime.0

Just thought I'd give you an update on my claim. I had offers for both business( in hubbies name) and joint account (now closed). Accepted both on 30th july. On Monday 13th August amount due for joint acc. was paid into business acc.Withdrew it first thing Tuesday morning then phoned, asking why this had happened and where was the funds due for business acc. Told that they would look into it and phone me back. Waited till 4.30 and called back. Told still waiting on Halifax getting back to them, would phone me on Wed. Waited again till 4.30, more or less told the same, but he would get on to them right away and phone me on Thursday. Still waiting for the phone call yet!! How hard can it be just to transfer the funds right into business account? They tried to give me some !!!! and bull story that the money comes out of 2 different pots
both are BOS accounts and would need to pay in the diff. between the Business claim and the joint claim (business was more). I should have got a cheque for the joint acc. but because of their mistake, it went into business. Now they are saying they will send a cheque for diff. I would rather have the funds paid into bus. acc. as I am a signatory on it, but they don't want to do this and would rather issue a cheque. Probably just buying more time, as it would take another week to clear.

Update on above,
Still no phone call however although the joint account has been closed since June 2006, I can still view it on-line, as it is linked to business account. Noticed tonight, that the amount due for joint account had been paid into the closed account. That's twice I've been paid. I suspect they will just pay in the difference due between the two into the business account. What a complete mix up. Not that I'm really bothered as I was able to use telephone banking on the closed account and transfer it over. At least I don't have to wait a week on a cheque clearing.

Does anyone have the number for the Halifax legal team?
I took the Halifax to court and they didn't acknowledge the claim so I won by default. I have tried to call the customer services to see when they would refund my money but they have said that their legal team is dealing with it and that they don't have their number (likely story).
I have sent them a letter stating I want the money refunded within 7 days (this was up on the 16th August) but I haven't heard anything from them.
Does anyone have the number or any suggestions.

My wife received the standard letter when she requested copies of her bank statements etc.
What I cannot understand thought is how a case at the High Court in England can be treated as a test case for Scottish Law - I am away to contact my local MSP and MP (both SNP) to make that point - I'll let you know if I make any progress.0 -

Thought id give an update on my claim.
was told 2 weeks that my money would be in my account within 48 hours.
Still waiting and phone bank today to be told that I wont be getting it after all.
I asked why? when I was told I would be etc: told woman on phone that It was granted due to the fact it was money from benefits. told that was that and nothin I or them could do about it (basically)
I said I found that appalling customer service and I was disgusted at the way I have been told one thing then another and passed from pillar to post, I have been extremley patient as I understood the backlog they must be dealing with, but after the lies I have been told in the past 2 weeks I will be closing my account and going elsewhere if this is the way they are going to treat customers.
I have just emailed the financial ombudsman(sp) complaining about this too

I've have just received a filed court defence from Halifax stating that they wish for the case to be stayed until further Order pending a final decesion on the test case.
I've read that the courts decided that all court cases that were filed after 13th August can be held until the decision, especially that of the Northampton court.
I filed our claim on 27.07.07 so can this defence be challenged?
I'm not sure what to do now, do I just leave it in the hands of the courts or write a counter claim ????
Anyone else had the same issue?

If the defence does not say anything further like what thier defence actually is then you should apply for summary judgemnton the grounds that on that defence you will win.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

The defence is simply asking for a stay, in paragrapgh 3 it states that they will file a defence within 28 days of teh expiration of the stay in proceedings...ie: once teh trial case is over...
In paragrapgh 4 it states they make no admissions to the particulars of the claim and denies that the claimant is entitled to the relief claimed or any relief whether as pleaded or at all.
I dont take this as a defence........so how do I proceed as you indicated? Should I wait for a court date in my local court or do I write to Northampton again.....
