    The defence is simply asking for a stay, in paragrapgh 3 it states that they will file a defence within 28 days of teh expiration of the stay in proceedings...ie: once teh trial case is over...

    In paragrapgh 4 it states they make no admissions to the particulars of the claim and denies that the claimant is entitled to the relief claimed or any relief whether as pleaded or at all.

    I dont take this as a defence........so how do I proceed as you indicated? Should I wait for a court date in my local court or do I write to Northampton again.....

    This amounts to no more than a bare denia. To apply for summary judgment you need to make an application on form N244. There will be a fee of £65.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Has anyone else done N244 form and succeeded......?
    Claiming the following:
    Natwest : 2177.00 (Settled for 2127.00, paid today 14.3.07:beer:
    Cap One: (me) 853.00 paid: 1059.05 20.04.07 :beer:
    Cap One: (hubby) claimed 718.18 13.04.07
    Halifax: 1836.00 plus int 283.82 int claimed 30.03.07
    Ikea : 324.00 plus 38.70 int (paid 340.00 20.03.07!!):beer:
    GE Money: 114.00 claimed 15.03.07 Settled for 90 :beer: :beer:
    :confused:Black Horse: 24.00 (ltr of request sent 15.03.07

    A N244 is used for any type of application which does not have its own application form.

    Hi there,

    I have been fighting to reclaim credit card cahrges from Halifax, Bank of Scotland and Sainsburys Bank, all of which are the same company.

    Sainsburys have given me a full refund of £395 with no issues. But Halifax and Bank of Scotland are being a bit difficult.

    I am claiming £346 inc interest from BOS and £238 form Halifax. I have been offered £150 form BOS and £100 from Halifax, it has said in the letters and the girl on the phone that they WILL NOT repay on the £12 charges and that is where they get their calculations from.

    Eventhough Sainsburys have paid out on the £12 charges. I dodn't know whether or not to accept the offers (they have already been reviewed) or to take it further for the full ammount. I have already offered to settle without interest but still not playing ball!!!

    If i do go further how do i do this as the card services contact details are all in Scotland, so i can't go via MCOL, or do i use the Ombusman?

    Hope someone can help.

    Hi Edinburghglass

    I have now received a defence from Halifax Solicitors detailing their defence and right to a Stay on our appliaction through MCOL.

    However, this is been channelled through the Northampton court and my questions are these:

    1) Can I apply to have the case transferred to Ipswich
    2) Can I do anything else to challenge this defence to get a hearing and if so is it worth it?
    3) If I do nothing, what happens next?

    I'm a little confused as to how to proceed and any advice help would be appeciated.

    Hi, I sent in form N244 Refusal of stay application and I have a hearing on 13th Sept to hear this application, will let you know the outcome.

    don't really know what to say at hearing, just going to heap on the finanacial hardship and human rights and the fairness of the situation, ie. banks able to apply charges but we're not allowed to do anything about it.

    Also my court never charged the fee for this form, i just sent the form in and a covering letter.

    Any chance you can let me know what you have written on the N244 form and what you covering letter says? Also did you transfer your hearing to a local court?

    :mad: Hi There. Recently Halifax bank took a £39 charge from our account resulting in 3 small payments amounting to less than £20 failing. They then took a £117 charge from our account. When we rang, they said that they had reversed charges in the past and are no longer willing to do so. I put in a letter of complaint that hasn't been answered 2 weeks later so i rang them up again today and they said that due to the current 'test case', there is nothing the Halifax or any other bank can do to reverse charges now and basically fobbed me off. Due to the £117 charge now another direct debit failed by a matter of a few pounds and another £39 is being taken on Wednesday taking us overdrawn till i get paid on Friday. This new test case has given the banks carte blanche to do what they want for the time being and its us that struggle. What can we do?? This has caused so much stress in our house. :mad:


    I had my charges refunded earlier on this year , and due to events above my control( emergency op on my back ) , I had 2 more charges on this account and tried to get them reversed ,and was told the same thing as you paul, well is it worth starting another claim or can you only do it once ?
