This is probably mentioned numberous times before but I can't find an actual answer. I took a partial payment from Halifax then received a letter to say I had to agree to take this as the full amount or if I don't then I have to pay it back if banks win the court case.....
Surely the money is a goodwill gesture so where do I stand?? Can they demand it back?? What should I do??0 -
Hi, Iam currently waiting for my case to be looked at as a hardship case as all the charge came off my benefits. I have phoned the bank and they told me to call back in 2 weeks for a decision, which i did, i then got told to call back after another 2 weeks which i did, i then got told to call back in another 2 weeks which i have (today) and they have now told me to call back in another 2 weeks. Should i just go to court over this rather than getting the run around. I would not loose any charge by waiting for the test case but as we struggle financially this money would help a lot.
Any comments would be gratefully appreciated.0 -

Well there certainly is a wealth of information on here, just wondering if someone can give me a quick low down on whats happening with the Halifax and reclaiming these charges in particular?
We have had a mistake with our account and this month alone 5 direct debits have bounced = £150 at least.:mad:
We sent a first letter off a few months ago and had a rejection letter and with everything on tv im confused now with what to do, whether to press ahead (and include these charges we have just received) or hold off. Need the money though!!!
Hope you can help by giving me a quick overview as there is quite a lot of conflicting info on here! xx0 -

However if you are using MCOL you need to use the Halifax address and not the Scottish address.0 -
You need to follow through your claim and start a court action. As the bank will likely defend and request a stay you will be better to file at your local court rather than through MCOL as Northampton Court which deals with all MCOL cases are putting a blanket stay on all cases that are defended.

I will be issuing my claim this Friday through my local court. My question is should the new Edinburgh Halifax address be the one that I show on my court paperwork, or should I use the Trinity Road address where all my previous letters have gone to??0

I have recived my bank statments from the Halifax, done my first letter with a list of all the bank charges plus intrest, Now do i send this this letter off or notI dont know what to do now after this announcment. Do i just carry on as normal or do i wait.
