Well after a ridiculous off £1000 for a £2400 claim and a MCOl issued against HBOS my money of £3070.22 went into my bank account last night!! thsts my fees, interest and court costs!!
stick with it everyone.. i know MCOls seem scary but they really are worth it and the only other way than the FO to get further forward..

I've just prepared a letter for HBOS....
don't fancy my chances but if i don't ask it'll only bother me for the rest of my life that i let £400 go without trying!
Even if i have to wait a year or so til it's all sorted, it's mostly 4-5 year old money anyway cause this account is better managed now..
I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Bank of Scotland.<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>
The charges total £420.00. I believe I have been unlawfully deprived of the money and therefore ask that you repay me the full amount. Please find a full schedule of the charges with this document. I have not requested payment of interest with this claim to aid a speedy resolution.<o:p></o:p>

I appreciate there is a hold on cases such as this at present for legal reasons. However I would ask you to consider settling my claim now for two reasons: Due to my excellent management of this account in recent years and also the fact that the claim amount is low.

I received a reply from HBOS dated 24th July offering me £888.50, (which is 50% of my total claim, less interest). as full and final settlement.This money was deposited in my account yesterday. I phoned the 01977 number yesterday (before I realised the money was in my account), and a young man informed me that I had to accept the money in full and final settlement or not at all. Is this true? He told me that I had 2 months to decide, and if I decide not to settle, that I would have to return the money to them. Can I now write to them and say that I would like to accept the money without prejudice, as part payment? If they refuse, can they take the money back from my account? Any advice would be gratefully received.

Thanks for replying Edinburghlass, but I've read Martin's advice and I'm still confused. As the Halifax have put the money in my bank account, am I within my rights to say I'm accepting it without prejudice, even though they said that it was in full and final settlement, or can they take it out of my account?0

I doubt very much if the bank would or even can take the money back but made sure you put it in writing to the bank that you are only accepting this in part payment.
If you do feel that the current offer is not enough you should contact your bank to say you do not accept its offer and that you will await the outcome of the test case to continue with your claim. The same is true, even if your bank automatically paid money into your account, just contact it to say "I don't accept this as a full and final settlement" (this is best to do in writing but if you do by phone make sure you keep a record). Alternatively you may still look to pursue Court Action.0 -

I've sent letters to them over the last 8 months (allowing for the 40 days they're allowed) all requesting my full statements (from my partial statements that I have I think I'll have about £200 of charges).
I've sent all the letters registered so they had to be signed for at the other end, which they were, but I've STILL not even had an acknowledgement. The £10 cheque I sent hasn't been cashed either. I've tried going into the bank but they said that it's not something they can do in branch, as I've already contacted them by post?!
I think I'm just gonna give up, especially as I don't understand the recent developments properly! *sigh*Pay off as much as you can in 2011 challenge #116 £394.24/£6722.580 -
Right After nearly 40 days got all my bank statements for the past 6 yrs today:D and was just about to start going through them to work out total cost of charges. The one think i am not sure of after this OFT Annoucement is it still worth me going ahead with requesting my money back from my bank do i have to wait till after this "Test Case" has gone through and been decided which way the high court/courts are goning to deal with this.
Any help would be most greatfull as i am confussed and not sure if i have to wait or not.

I am claiming the best part of £4000 for the Halifax. I have just received a letter dated 25th July offering £1780 as a 'gesture of goodwill' and in full and final settlement.
Obviously this letter was dated before events on Friday 27th.
Any advice please?0
