    You should wait until you get the money before closing your claim with the court.

    Hey im new here
    Im with halifax and have been for years, I had £7.60 coming out of my account by Tesco insurance. They tried to take it out but it did as I had no money in their or no over draft.
    I phoned halifax and they said I wouldnt be changed that time.
    I happened again, the money bounced again and halifax charged me £39.00 yesterday, I have spoken to halifax and they have said theres nothing they can do, but there might be someone on here who can help me.
    Also I was with Barcleys a few years ago (about 4) and they charge me loads of time sover 2 years for cheques bouncing. I think it was about £50.00 everytime one bounced, can I reclaim that?

    I have 3 times in the last few months had bounced direct debits just because they come at the same time and I only ever have £x in my account because I am a student and lack money. So £117 of fines which I'd love to get back - is it possible?

    sorry, that might not be clear, my question is whether there is a lower limit to the amount before it would not be frowned upon to claim?

    I have just had an offer from HBOS for both personal and business accounts.
    On numerous occasions over the past 5 years, I have phoned up and had charges refunded. Don't let them fob you off, they'll try anything,

    Hi all, I wonder if anyone can advise me on my situation.

    I got a rejection from Halifax some time ago, i then rang & said I wanted the case re evaluating, the lad said no problem but they had until 30th August, I hve basically left them too it.

    Obviously given the new ruling that things are on hold do I ring them & see what they say, as I suppose I will get the reply of 'Things are on hold mate'

    If this is the answer am I able to pursue through the courts as someone suggested in this thread, think it was edinburghlass? In all honesty I would accept the £864 in charges but if I have to go via the courts it's £1300+ my MCOL.

    Any help would be appreciated

    WHAT THE H*LL, I just got home to find another charge from them!! £30 because an £8 direct debit didn't go through, and I don't even know why that was because there's about £500 in the account! Seriously I HATE HALICRAPS, this is it; tomorrow I'm going to empty every acccount I have with them and payoff and close my credit card - I've had ENOUGH. I'm thinking Barclays...

    Is there anything I can do to get this £147 back?

    Firstly, thanks for reading. I'll outline my situation first before asking questions.

    I am with Bank of Scotland/Halifax and have been for over ten years.
    I have asked for £3708 (including interest) of bank charges to be refunded, using Martin's template letters. My full intention has been to keep going until I get everything back, NOT accept half payments to get it over with quicker etc. This is less out of greed than the fact that I desperately need the cash.

    First they wrote to me saying that they wouldn't refund any. So I wrote back again threatening to take them to court if they didn't refund me. I then very quickly received a reply on July 14th offering £1,691 'as a gesture of goodwill'. They added

    'this does not mean we believe we are under any legal obligation to do so'.

    Then they added that it

    'is in full and final settlement of your complaint'.

    They said

    'to accept this payment you do not need to take any further action as the payment will be credited to your account within the next 14 days. If you do not wish to accept our offer, please return the payment and contact me'.

    So I tried to contact him but, surprise, no reply. I then rang customer relations and discovered the payment had already gone into my account. At the call centre, on July 24th, they assured me that if I wished to continue to claim the remaining amount that I could hold onto/spend/do what I wish with the £1,691 and that if the bank made me another offer they would simply add this to my account. The woman who dealt with me sent an email to the man who had sent me the letter, stating that I wanted to renegotiate and asking him to call me urgently. He has never called.

    I then sent them a letter, on the same day (24th), saying that I had received their letter of offer and that the money had been credited to my account but that their response was not satisfactory and that I would be claiming the remaining £2017 through the county court.

    Today (July 31st) I rang the call centre to see what was happening. They said they had not received my letter of July 24th. I was then told by someone that they had ceased negotiations because of the OFT court case and that I would soon be receiving a letter giving me 2 options: I could either accept the offer (in which case the matter would be closed and I would be unable to claim the remaining £2017 ever, regardless of the OFT case outcome). Or I could reject the offer, in which case it would be taken out of my account.

    I'm wondering if there are any loopholes in the fact that:

    A. The original letter of offer (on July 14th) said that 'to accept this payment you do not need to take further action'. So I did not have to sign anything. Might this then make me excempt from signing the binding letter they will send soon giving me the offer of final acceptance or rejection?

    B. My last letter of July 24th (which they haven't received but still might) will be postmarked and dated BEFORE they changed tack. Might this give me some clout?

    If anyone can give me some advice, I'd be really grateful. Do they have me by the curlies?

  • If the Banks particulary Bank of Scotland are going to send a standard rejection letter would it spead things up if the matter was taken to the Ombudsman, the Bank of Scotland have ignored several letters I have sent, and sent a letter last week stating if they did not repay bank charges I would be charging interest as well, I am now expecting a standard rejection, so wondered if instead of taking them to court I wrote to the ombudsman they might be able to make things move along more quickly

    Ring them & ask for it back Id be polite though, then take it further with their Customer Service lot, then maybe contact the FO going down the route they keep charging you when you dont have the money in the account...
