I phoned the number on the last letter again to request the £1500 that was paid into my account be removed. I was told 'I' had to go into a branch and do it over the counter :mad: I told them I did'nt ask them to put the money in so they can take it out without wasting my time. The chap on the phone then started to call me 'Pal' eg: 'Sorry Pal you will have to go into a branch' of course i saw a little red and asked him if it was policy to instead of calling Customers Sir or Madame 'PAl' was now the thing to say. He quickly reverted back to 'Sir' and passed me over to a supervisor, who got both barrels, after several periods of being put on hold i was then told that the moeny in the account would stay there until the case was heard in Court and the Bank were aware that I made no claim to it.
I'm finding it hard enough as it is not crawling back to them and accepting the 75%, without them playing this moeny in the account game.0 -

Really glad its not just me then!!There seems to be a lot of people settling for the 75% .. probably more since that rule came in on Monday.
Mcol has been issued today so now the 5 days to have it served kicked in and the wait to have them acknowledge and I assume defend... Ive no idea how far halifax will take this and whether I'll get a realistic offer before court bundles and dates are announced. Really hope so.... HSBCs claim was a breeze compared to this one...

I've just been offered 600 instead of the 776(interest included) and i dont know wether or not to accept....
to be fair, without the interest, they're offering me around about 90% of what ive payed in charges.
I told them i'd call them back. what do you guys think?0 -
Dinky, it sounds like a good offer. Things are getting tougher and this maybe worth taking to avoid more struggle.
£600 is not bad... depends how brave you're feeling. And have you got other fish to fry claim wise? And are you skint enough to benefit from £600 in the next 14 days..... sooner if you push them, or you get lucky!I'm just a seething mass of contradictions....(it's part of my charm!)0 -

There is a thread on here somewhere (dont ask me where ha ha!)
Your MCOL will be sent to them and deemed served after 5 days - which means you are formally letting them know you are taking them to small claims court.
After the 5 days they have 14 days to acknowledge - this means yes they ve got the papers and theyunderstand you are taking them to court.
Once they have acknowledged they then have 28 (i think) days to respond by either admitting or defending.
Some banks are putting in a defence under the pretense of actually going to court in front of the judge... A court date may be set at this point once your claim is transferred to your local court. some banks are coming back with offers well in advance of the date, others dont log a defence at all and you can win your claim by default...

WELL..... Acknowledgement took place on the 11th of July so i've got 20 days to go. I wont start putting my side of the story together until a couple of days before the Court date.
I have a five month old daughter at home who is keeping me distracted enough, from thinking about the £2k i turned down.
Something else to think about which i do not believe is a conicidence My Halifax credit card has had it limit slashed by 50% after i paid off some 50% off my bill last month. I phoned today and asked why i had'nt recieved a letter explaining thier actions only to be told this only happened on the 17th, the same day i turned down thier offer :mad: :eek:
I think its time i asked for 6 years worth of statements from Halifax credit card dont you :cool:0 -
I feel that my days at the Halifax are numbered, thankfully i have another account open elsewhere with all the same facilitys.0
