    Can anyone help me?

    I requested statements at the end of May/beginning of June. At the end of June I got a letter to say that the request would be dealt with within 40 days. Unfortunately I chucked the letter. I haven't received any info yet. Can someone give me the number to chase these up? I know it's not 40 working days yet but it's close to it.

    Also can someone advise on my best tactic. I have 3 accounts to claim on from Halifax. 2 joint and 1 in my name only. Can I do the joint claims in my name only or does my OH have to be involved? Also do I do 1 claim for all 3 or do I do them separately.

    You will have to list charges etc separately for each account and do 3 separate claims. However if you decide to go down the Ombudsman route, you can put all 3 claims on the one complaint form, as long as they are with the same bank.

    Can anyone help?

    I originally started a claim against Halifax in August 2006 for my husband who had approx £1700 to claim in unfair charges (without interest). I got to the Letter Before Action stage and he was offered partial settlement of approx £700. I followed all the procedures (accepting the offer only as a partial settlement and advised that he would be continuing for court action), but then my husband and I separated and he did not actually complete the process.

    I started the claim again (July 2007) and have just sent out the Letter Before Action for the second time. Now he is claiming approx £2500 which have built up in charges because he had requested for all his direct debits to be cancelled, but this was not actioned and charges continued to be added.

    Will the fact that he did not complete the process the first time around count against him?

    He has not received any settlement offers. Should we be worried?

    Is there anything that should be done differently because we are repeating the process and did not carry it through the first time?

    Will the fact that he has accrued so much in charges within the period do any damage to his case?

    What steps should we be making towards his defence (bearing in mind that he has just sent off his Letter Before Action and he has yet to receive any response)?

    Has anybody been in or know of any cases with a similar situation?

    Any help or advice that you can offer would be greatly appreciated. My husband, and even I, panic at the thought of having to go to court.

    shouldnt be any problem provided no court action was taken(i think).give them 2 weeks to answer and then start your claim.have you got your statements?i wrote all the illegal charges on paper and included this in all my letters to them.dont worry when you get to the court stage there's lots of help here.the banks are hoping to scare us all off.we're in the right the're in the wrong.good luck

    Mullan, Halifax offered me £1100 on Monday so I rng them as I am claiming £2200. The woman (Gemma Booth) on the phone raised the offer to £1650 whcih is 755 of my charges. I said that as I had initiated court proceedings I would gladly settle for £2320 (chrges plus court cost) she said she was unable to go higher than £1650. I informed her that I would be continuing with my court action.

    Looked at Bank account today as my wife has been paid and guess what.....Halifax have deposited £1100 in our account!!!! I am spitting chips :mad: as its not even the "maximum" £1650 they offered. Now waiting until the clock strikes 09:30am and am back on the phone to them.

    Don't give up....its our money!

    This is a bit of an urban myth about the FO and credit card charges. It is OFT who suggest £12 is a "reasonable charge" and if you are putting your claim through the FO they will claim for the full amount and in fact one user's FO adviser is asking Egg to give a break down of how they reach their charge of £16.

    Really glad its not just me then!! beerchug.gif There seems to be a lot of people settling for the 75% .. probably more since that rule came in on Monday.

    Mcol has been issued today so now the 5 days to have it served kicked in and the wait to have them acknowledge and I assume defend... Ive no idea how far halifax will take this and whether I'll get a realistic offer before court bundles and dates are announced. Really hope so.... HSBCs claim was a breeze compared to this one...

    Halifax wrote to me last week offering me a third of my claim (currently with moneyclaim) and giving me 7 days to accept - yet after only 4 days they have credited my account with this money despite me not making any contact to accept.

    Has this happened to anyone else out there and is this some sort of cunning ploy? Will it affect my claim now? Help and advice on what I should do please.

    i'm claiming £1374.32 recieved a letter saying they r going to put 560.00 into my account as goodwill gesture so i phoned them telling them not to bother as court proceedings were now underway so she upped the offer to 850.00 of course i said no so i guess i'm off to court will keep ya updated:rolleyes:
    wonder if they'll put in defence????
  • I am currently claiming the massive sum of £205. Its purely principle you know. They had the cheek to put 2 bank charges of £30 on the one letter so I claimed all the charges I had note of at the time.

    My initial letter to the bank was sent in late February 2007, and since then I have suffered stalling tactics from the bank and admin problems at the court. Nonetheless, the bank have not made me any offer and have not defended in court.

    As I speak, the Sheriff Officers are getting ready to visit my branch and demand my dosh back. I am a little concerned that the bank will close my account, but worse things can happen to me, I could be robbed of £205 again.
