  • I received a letter from Halifax on 28th June, stating that without admission of liability, they were willing to reimburse the whole amount of my claim (>£1250). Said "the amount would be paid into my account within the next 5 working days"

    They didn't pay me!!

    I called and they said that the money had been requested, but they didn't know why it wasn't in my account.

    I am tired of their deliberate games to friustrate this process

    The final day for Halifax to have filed a defence was 2nd July. I now wish to enter a JUDGEMENT BY DEFAULT. However, I would like to know whether I choose;
    • The defendant has not filed an admission or defence to my claim, OR
    • The defendant admits that all the money is owed
    (Please not I refer to the Money Claim web site)

    Can anyone with experience / knowledge of this please advise. I do not want to trip up onn the last hurdle.

    I do hope that in this situation that although you have in writing the offer of payment that if you then take the case to court whether or not it reverts to the whole process of claiming again ie they potentially could say the offer nothing?? or could you submit the offer letter as part of your defence?

    Hi, I wonder if someone could help please.

    I've sent my first letter to Bank of Scotland, enclosing my highlighted statement, requesting my charges back. They replied saying they won't be refunding them, as it is in my terms and conditions and that they can't provide information of how the charges are calculated, because this is "commercially sensitive information". Should I carry on with my second letter or can they get out of it with the t&cs? :confused:

    A fob off letter they've replied to you with, carry on with your second letter :) stick to your timescales.

    Hi they have refused you so you can know report themto the financial ombudsman send all letters sent and received from the bank of scotland regarding your complaint. They normally get this fixed within 6 wks of your complaint this is the step I went as was also refused from the bank of scotland

    send all info recorded delivery or email them with complaint forms and all the letters sent and recieved attatched to your complaint form here are the links

    Hi everyone

    I've been chasing a claim started with BOS since March now and am getting completely fed up. My claim is for £900 for an account that has been closed two years ago.

    Basically they offered me 50% of my original claim, which I called up to speak to a representative. At the time the lady who answered was very helpful. I explained that I was not declining their offer, but would like it reviewed again. She acknowledged my point and said to wait and she would 'escalate' it up to be looked at again - this was the beginning of June.

    After several weeks had passed, I called them again. A extremely rude lady answered who basically told me it had been 'escalated' and would be answered within 8 weeks. She was awful on the phone and said 'Well you did decline the offer' I explained I had simply asked for it to be reviewed and despite me being very polite in the hope she would at least give me some details as to when I would hear, she actually slammed the phone down, when I was asking her a question... which left me completely shocked.

    It's getting to the stage where 8 weeks are almost up, and I'm now regretting phoning to discuss this offer and not writing instead. Can they close this offer down after 8 weeks? I'm not confident in the staff that they are telling the truth when you call.

    Has anyone has a similar experience? I've just been made redundant and am reluctant to put this down the court route.

    Any advice would be very much appreciated.

    Hi all,
    Update. It's now nearly 4 weeks since I handed my details over to the FOS and today I have received a reply, stating that they have invited the BOS to repay me in full or provide them with information that they need to reach a conclusion on the merits of my claim. Hope this doesn't take much longer, as this has been ongoing now since 16th Jan.

    Has anybody here had success claiming from the HBOS through the FOS

    Just received a partial offer this morning.

    Claiming £ 1874.65

    They have offered £1039.50.

    What is the general concensus regarding partial offers? Is it worth declining and holding out for the full amount? :confused:
