First post, but been reading (and learning!) for six months or more. I've been down the suggested claim route, but never got anywhere - well, I got as far as Halifax saying "we've got 8 weeks to reply to you"...and they did. After 8 weeks they sent a letter that basically said "we've looked at your case, and we've decided we're not going to give you any charges back as we're allowed to charge you coz our T's & C's say we can".....
And that's it - I never filed with MCOL (too skint to stump up £120 at the time) and it's all just died a death since then - I think their letter got to me around the middle of May
Soooo....my question is this: Can I pick up where I left off and file with MCOL (total is about £1600 including the interest), or do I need to go back to the beginning/middle and start sending letters again? I feel like a bit of an idiot - if I'd had the cash to file, I would have but instead I just got all disheartened and gave up.......
Can someone (if anyone's ever been this dumb before) give me some advice as to how I can get the ball rolling again..if indeed I can.

Alternatively you can put your claim through the Financial Ombudsman if you don't want to go down the court route. Please read Martin's article for his update on using the FO.0 -

I was in a similar position (3k) so i telephoned customer relations on
0151 2247 562 and asked them to reconsider. They offered me 1,357 over the phone. I then received a letter to advise this which i respectivly declined and threatend that i would persue this in 7 days through the courts. (even tho i had no money to pay for court costs)
They then repaid all charges direct into bank!!
Soooo, why dont you give them a ring and ask them to look at your account again, cos it sounds like you had a standard letter of refusal as i did.
You have got this far, so keep going.....

I'm in same position - halifax defending my court action and i'm getting worried - they owe me £2,700. I don't know what else to do. Do they wait until 28 days is up then give in? or will they turn up in court?jayney0

Hi,i have been succesful in claiming back my bank charges from BOS.I am now aiming to get charges back from my credit card with them to,do i use the same 1st letter?:rolleyes: Jan grocery challenge £300/£210 spent so far.I can do this:T0

still waiting for my money to be paid by Halifax - £5300+ their letter was dated 6th July, so just sitting on hands waiting impatiently!!! I'm giving them a ring this week to ask where it is but to those still fighting, don't give up.
I managed to get my final offer by sending two letters (1 asking for statements and 1 asking for money back) I made several calls (one saying re-evaluate, 3 chasing re-evaluation) received my 50% offer letter and final call to negiotiate full amount (no interest). this was all from April to July, so be nice and be patient it took 7 weeks of re-evaluating before i had an offer.0 -

Even if they have defended, Halifax will not be willing to go to court and defend it. Its a way of buying time to get you to accept a lower offer. You may not realise it but you actually have the advantage here as you have started the court proceedings. Try writing a letter like I did to Capital One (link below), they had entered a defence at court too but it didn't stop them from increasing their offer from £303 to £1,489 over night

If you use the letter that just refers to 'default charges' you're fine.
Other wise change the letter to read... we are now on letter 3 to the halifax threatening court action as they have refused to repay the charges of £432.14. this was sent on 24th june giving them 14 days to respond. we have not heard anything. do we contact them again or file a claim through the county court?0
