Can someone please clarify if the total charges which can be reclaimed differ in Scotland? I've only just realised that the law in Scotland only allows you to claim back five years instead of six and that the small claims court only deals with claims up to a maximum of £750.
Being a bit slow to realise this (and naturally blonde!!) I've already sent the first two letters to the BOS requesting my charges be refunded (which amount to over £1600) to no avail!! Before I do anything else, I'd really appreciate some advice. If I cannot claim back more than £750 through the Scottish small claims court, should I then only be asking for £750 to be refunded?0 -
No, you probably need to put your claim through the Financial Ombudsman should it get that far but please read this thread and try for a re-evaluation of your claim.

hiya all, im also with the Halifax have been since 1990, i sent 2 of the first letter asking for my statements going back 6yrs along with a £10 p.o which were both cashed, i recieved 2 x cheques back for the £10 as they are NOT charging for this information... i have basically given them 40days from the 1st letter, another 40 days for the 2nd letter (same as the 1st), response was 'in great demand for this information, should be no problem giving me the information within 40 days' this was up 9th July 07, so i hand delivered another letter giving them a further 7days, only to recieve a copy of the 1st letter land on my doorstep on the 11th July - ermm with NO telephone number on who to contact. Tomorrow Monday 16th July im going into my local Halifax branch, as from my original request they have had 87 days - hmm i think thats more then being fair - dont you!! by the way has anyone had a positive outcome with the Halifax?? please let me know - cheers xx0

Thanks for that Edinburghlass. Will def read through all that thread too. Clearly should've read more first cos I'm begining to wonder if I've even been writing to the correct people.
In both instances I sent a letter to Trinity Road, Halifax and a copy to my local BOS branch. ie, (on 19th May requested that they pay back the charges - received the standard 'no can do', therefore on 22nd June threatened court action - received no aknowledgement). I now suspect that I should've sent the last letter to the Customer Relations Dpt in Dunfermiline. Do you think I should now post a copy to Dunfermilne and wait or just go ahead and phone?
ps. Although the blonde comment was true, I'm really not normally this stupid!!:rotfl:0 -
It doesn't really matter where you posted it to as they will forward to the correct departments. Provided you have a claim number make the call tomorrow and see how it goes.0

You should really read Martin's article!
If they go past the initial 40 days you need to put in a complaint to the Information Commissioner www.ICO.gov.uk

hi all neverthought ide get to this stage but recieved a letter with an offer its only 40% of the amount asked for so im going to call tomorro and say that i dont accept an the least i would accept is 75% min
is that suggestion about right is it to low?
should i hold out0
