Update.- It is 14 days since I sent LBA for hubbies business account, so I phoned them to get an update.I was advised that the man dealing with my case was off (how convenient!!) and that it was being re-assessed. I advised him that it was now only 10 days until 8 weeks deadline. He replied that they have 8 weeks from receiving 1st letter which was 8th May. This is getting back to the problem I had regarding the wrong address etc. when letter was sent on 19th April to address given to me by FOS. I then phoned the FOS, gave my reference no. and told her of situation. She got quite annoyed (with BOS not me !)and told me to get back in touch with them, to advise them that they had also sent a letter on 19th April advising that they were aware of my claim. She stated that they have a list of executive offices that they send all correspondance to for each bank and this was the one they had for the Bank of Scotland. No matter what BOS might say, the FOS will be treating the 19th April for my claim date. I will take great pleasure in writing this letter to them. To think that it was 16th January that I first asked for statements, I have been fobbed off so many times:mad:0 -
Hi i am looking for some clarification on what i should do now, i have followed the suggested steps and have now waited on bos getting in touch regarding a settlement which i got today telling me i accepted terms and conditions and so i am entitled to nothing, what now? can anyone advise please.0

I know the feeling I cannot afford the MCOL fees so I am going through the onbudsman route. I am in the stages of drafting the complaint using the templates set out here and will post them once they are completed for others to copy, modify, suggest improvements to.....:beer: "I'm Just A Demin Boy":beer:

Bill Payment Account claimed :- £3800 plus interest

I also feel that since february i have made very little progress with my claim, although i had passed the information available on this site to friends who have been awarded their charges back. No fair I say. But i am also thinking about using the financial ombusman to try resolve the issue now. Thanks for your comments, i feel it is important that we continue to persue this as we deserve our money back and even if it was only a few £ better in our pockets than theirs.0

I just want to say to everyone what a brilliant response I had from coventry building society. Last thursday I phoned up for six years of statements, by next morning I had them all without any cost to myself. I send a letter on sat claiming 520 and recieved cheque today two days later for full amount!!!!!
this is excellent, its the opposite to halifax. I have filed my court paper, and online it says this has been accepted, since then I have heard nothing, but excpect they will file a defence

I noticed on-line this morning that I was going to be £53 o/drawn, due to three payments coming off overnight. I have another account with a diff. bank but it would take 4 days to transfer. So I phoned my son who has an acc. with the same branch and asked him to do an immediate transfer of £60 to avoid getting these items returned and incurr charges of £105. He tried to do this and was advised he couldn't ( ps. I have done it for him on numerous occasions, to help him out ). He was told that as mine was a business acc. it would take 4 days. For gods sake, it's the same branch!! I phoned business banking as I am almost positive I did this when I had my personal acc. with BOS. I was advised the same, so asked to speak to a business manager and get this SHE HAD NEVER HEARD OF THIS. However, she was very nice and said she would put in a request for these items to be paid as long as I deposit funds today, to cover the amount. She had no access to personal accounts, but advised my son to phone back and not hang up until he had a satisfactory explanation. So fingers crossed, I've just saved £105, just by making a phone call.To think that mine and my sons accounts are probably listed more or less next to each other,having the same surname, yet it takes 4 days for funds to go from his to mine. Absolute bull!!!! Sorry to go on a bit, but in the past I would just have accepted these charges, not any more!!
Update 10.22 - Just had a call from the very nice business manager I spoke to earlier to advise me that my items had been paid and no charges levied. YESSS!0 -
UPDATE
I have received a notice of transfer of proceedings saying a defence has been filed. Accompanying that is a piece of paper which says that
"without hearing it is ordered that the filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise, that any party affected by this Order may under Rule 3.3(5) apply to have it set aside, varied or stayed. Such a party must apply under Rule 23.3 within 14 days of service of this order. Please note that an allocation fee may be payable in this instance."
The Defence then follows, which states that they have paid part of the monies but that "it appears from the Claim Form that the remainder of the Claimant's claim, £1,261.84 relates to bank charges but the Claimant has failed to provide particulars of how this figure was arrived at and the figure is not supported by the Defendant's records.
On the basis of the matters pleaded above, the Defendant denies that it is liable to the Claimant for the sum of £1,261.84 in respect of the balance of her claim or for any other sum, and the Claimant is put to strict proof of the same."
I don't understand this - they seem to be saying that I haven't provided particulars but the whole claim was listed on one sheet and they paid up on the ones going back six years, but don't seem to have paid back the last years. I'm also a bit worried about the strict proof bit. Any ideas, anyone?0 -
:wall: I went into my local branch of the halifax the other day to ask why i had not recieved a response to my first letter requesting my information under the data protection act. firstly my contact pretended not to know what i was talking about until i was absolutely precise about the data protection act then she went to find out what the delay was, this is what she said when she came back-all requests under the data protection act are currently being dealt with on day 49 due to the bank recieving approximately 2000 requests a day at this current time, however if i should wish to claim my bank charges without actually obtaining this info i could contact their customer complaints department-this to me smacks of misdirection on the banks part as i am not making a complaint, also they are admitting to me that they are failing in their duties under the said act,should i complain to the ombudsman at this time. any opinions on this would be usefull :wall:0

Well folks,
I have today received letters declining my request for refunds for both accounts. The BOS left it to the very last day to respond. I had to have a decision before the 14th or I would be referring to FOS. They tried to bull!!!t me by saying that it doesn't affect business accounts. I called business banking up and was told that the BOS had decided not to pay out on business accounts. I asked if she could send me a breakdown of how the charges were made up and she said they didn't have the facilities to do this HA HA!!! I then phoned regarding personal acc. and once again the line was engaged surprise surprise! I was really expecting them to come up with an offer of some kind, within the 8 weeks. So afraid it's now down to the FOS. I hope they are a bit more successful than I have been. I originally asked for charges without interest. Can anybody advise if I should use the calculator and ask the FOS to include it in my claim.:mad:

Well, have decided to go for the interest aswell, after noticing in the decline letter that they want to help me manage my account and that further charges will be added if I continue to run it in this way.( it's been closed for a year). That's them that have been investigating my acc. for 8 weeks!!0
