I spoke today with the customer relations department regarding my request for statement on 7th April which have still not arrived. They told me the fact I received a letter from them informing me they were dealing with my complaint means they have acknowledged it and will send them out.

I said "whats next" (playing dumb). SHe said once they send them to you they are looked at by a manager to see if the case should be accepted or declined based on the situation of the account when the charges were applied. If it is declined they will let you know - end of story - if accepted they will make an offer.

Hope this gives an insight in how they are currently choosing claims to pay out on.

This is what I though they were up to, I am holding onto the 6th of June to see what happens with my case. I suspect that they will knock me back.

Finally, after a loooooong wait, my bank statements arrived. So, tonight, my claim letter will go off to the bank by recorded delivery and I'll be asking for a total of £2765 inc interest.

I've never really had any luck when it comes to money, so I'm not very optimistic about the outcome of this but we shall see.

You can't ask for interest at this stage, you can only threaten them with it should it come to court proceedings.

    Hi Folks
    Another wee update.
Regarding my hubbies business acc. One of his customers was due to transfer funds into his account through the week ( for ongoing work ) in order that they would clear by today, as he had direct debits coming off. The customer forgot and paid by cash last night. I went down today to pay cash in to cover payments. On checking acc.on-line, I note that the payments had already been returned. I phoned and asked if they could be refunded and was told NOI then advised the girl that I had an ongoing claim which was due a result in 14 days and would then be handed over to FOS and that I would add todays charges on when it was passed to the them. Does anybody know if I can do this and what would be the situation if they come back to me with an offer before the 8 weeks deadline. ( I intend to haggle if it comes to it!) Would I be entitled to add these on or would I have to stick to the original claim. I'm so bloody angry as most of the charges were applied a couple of years ago and we've been really good since then because of this wee slip up it's costing another £70

OOPS Just noticed that a d/d was returned yesterday( this was the day the money was due in account.) So total charges are now £105. I'm absolutly raging. When I think the work my hubby puts in to earn £105, and these so'n'so's get it for pushing a button 3 times!!!!

    Hi Dave,
I too am claiming from HBOS for both personal and business accounts. They tried to fob me off, with regards to wrong address and saying they didn't receive letters etc. Not sure if you are with the Halifax or Bank of Scotland. I am with Bank of Scotland and despite being advised by the FOS where to send request for payment, I heard nothing from BOS regarding bus. acc. although they did acknowledge my request for personal acc. The correct address to send personal one is -
    CUSTOMER RELATIONS MANAGER,
    SCOTLAND DUNDAS HOUSE,
    VIKING WAY,
    ROSYTH,
    FIFE,
    KY11 2UU

    and business one is -
    BANK OF SCOTLAND,
    BUSINESS BANKING CUSTOMER CARE,
    1ST FLOOR,
    BUSINESS BANKING HOUSE,
    600, GORGIE ROAD,
    EDINBURGH,
    EH11 3XP.

I would send both by Special Delivery, as I have read that sometimes they bulk sign for registered and as I first sent the business request to the Fife address, it wasn't until 14 days later when I phoned for an update that I was told they had not received it and it should have been sent to Gorgie Road. On checking Royal Mail website, I noted that neither had been signed for at Fife address. I now send all correspondance Special Delivery.

I am still waiting for any offers for both accounts, and they have approx. 2 weeks till the 8 weeks deadline. I then intend to hand my case over to the FOS to deal with, Although I have sent an LBA regarding business acc. thinking that it might push them on a bit (aye right!!!)
    Regards,
    izzy

    Hi Dave,
On returning home from shopping today, I discovered postie had delivered me 3rd set of statements for personal account. I think their system must be in meltdown!!! I also contacted the FOS at the first instance when requesting payment, to ask for address. They advised me that they would also send a letter to BOS advising them that they were aware of my claim and noted the dates. IZZY

I got a letter from HBOS today regarding a claim for just one charge of £39.00.

They decided after my persistent letter writing and threats of court action to settle at 50% of the charge.

I decided to accept thinking that the case might be too trivial for court and might risk getting thrown out.

The only other way I could pursue the rest is through the Ombudsman which I may still do.

    MC
    MBNA CC: -£8390
    Father-in-law loan: -£4500
    Student loans: -£17,120

    Total debt: -£30,010

Well done on your victory, Both my claims have been knocked back, but after a phone call this morning they have promised to escilate and re-evaluate my claims.

It seems to me that the bank is making a judgement on what claims to settle and as I no longer use my bank of scotland accounts as my main accounts (due to their abysmal customer service) then they are willing to risk me taking court action against them.

To get as far as I have done with my claims has been a battle of wills against them, and yet I am still only slightly further on than when I started way back in January/ feburary this year.

As I cannot afford court fees I am now contemplating getting a third party in to take them to court on my behalf, any advice on who to use would be greatley appreciated.....
