Please help - has anyone else used MCOL against BOS and if so, what was the outcome. Judgement by default was due today, and the Bank has today intimated that they intend to dispute the whole amount of the claim, despite having lodged monies into the accounts on Friday - see above. Phoneline says they have paid me 5 years charges, plus interest, plus my court fees because the account is held at a Scottish branch address and therefore is under Scots Law. I asked why the bank had not thrown it out because they disputed jurisdiction and therefore didn't have to pay anything but didn't get an answer.

Can anyone help - I'm seriously worried and really don't want to go to Court - do I have to get a solicitor or what?

Have they paid you the money according to what they say? ie 5 years, interest and court fees? If they have then there is no reason for you to be going to court?

    Dear Edinburghlass

Thanks for quick reply. They have paid 5 years, interest and costs but I thought that since I was going through English system I could go back 6 years?

You can try but the bank have already said they will contest this due to them being based in Scotland and under the jurisdiction of Scots Law.

You could accept the monies as part payment, without prejudice, and say you will continue to court for the remainder but then you need to to do a bit of reading up about this, try here...

They are on a sticky wicket though with having local branches which operate under English Law.

I wonder where the computer is that actually decides on levying the charge. Is it done at branch level or is a mainframe hidden away in Dr No's island retreat in a cavern decorated in 24ct gold flake?

I think their mainframe is hidden in a building just down the road from me :)

The same way as everyone else.

Don't bother with phone calls. You'll be given the run around and unless you record them you won't be able to include them in your court bundle.

If you are following the templates from the main site then you just do what you told them you are going to do and when you told them you would do it.
