    Hi all,
    Just an update on my request for refund on hubbies business account with Bank of Scotland.
    Received an acknowledgment today, stating that I knew Terms & Conditions etc. etc that apply to the account. Also they have noted that refunds have been authorised in the past, therefore they are not willing to authorise any further refunds. ( I detailed these refunds in the schedule and subtracted them in total refund requested ). They advised that if they have no response within the next 8 weeks, they would regard my complaint as closed.
    I phoned the FOS for some advise and was advised to respond to this letter and if I had no satisfaction by 14th June, ie 8 weeks from 1st request for refund, then to contact them and they would continue with claim on my behalf.
    As I am not taking the court route and am using the FOS as I live in Scotland, is there a template letter I can use for my next approach, or do I bluff it and send an LBA, Thanks IZZY

    Well I sent away a letter to HBOS to reclaim the charges plus interest.
    I have today received the following letter:
    What should I do now?

    Hi there,

    :confused: Just needing a bit of advice. I'm claiming £1264.31 from one account and £1490.26 from another. I'm at the stage with MCOL that judgement can be requested tomorrow, as BOS have acknowledged the claim.

    Anyway, yesterday I was checking my accounts online and somebody had kindly paid in £667 and £87.41 into one account and £610 and £248.32 into the other. I telephoned Phoneline and asked who had done that and was told it was customer services. I said that I didn't want it as judgement was due on Monday and to take it out and anyway, why had they put in two separate amounts. I was told I had to take it up with customer services who were closed at this time, and that they quite often "scattered the payments".

    My question is do I go ahead and request judgement tomorrow and what do I do about the money in my account.

    Does anybody have a telephone number for HBOS customer services. I am still waiting for my statements and think I need to talk to somebody!!!

    I don't know if you've tried this, but as I said in my previous post I telephoned Phoneline (08457 213141) and they said they could put me through to Customer Services, so you could either ask to be put through or ask them for the number. Phoneline is available 24 hours a day, but Customer Services are not.

    Believe it or not I received a letter from Customer Services this morning refusing to refund charges (having refunded £1612.73 on Friday!) :confused: The address is given as PO Box 29112, Dunfermline, KY11 2 ZX and the telephone number is 01977 627487.

    Please help - has anyone else used MCOL against BOS and if so, what was the outcome. Judgement by default was due today, and the Bank has today intimated that they intend to dispute the whole amount of the claim, despite having lodged monies into the accounts on Friday - see above. Phoneline says they have paid me 5 years charges, plus interest, plus my court fees because the account is held at a Scottish branch address and therefore is under Scots Law. I asked why the bank had not thrown it out because they disputed jurisdiction and therefore didn't have to pay anything but didn't get an answer.

    Can anyone help - I'm seriously worried and really don't want to go to Court - do I have to get a solicitor or what?
