If you are waiting on a rtesponse to a SAR,as I was just ring them and tell them you've spoken to the INFORMATION COMMISSIONERS OFFICE and they have advised you that they have exactly forty days from receipt of your request.

I got my statements on the Friday from a phonecall on the Monday.

I am stuck for an address for HBOS in England, I need it to put on my court documents/case which I'm lining up just incase they mess me around. I want it in the barrel ready to fire out instantly on receipt of nonsense from them.

Give the Financial Ombudsmen Services a ring, they have a note of all addresses, where documents need to be sent. 08450801800 they were very helpful to me,

Woo Hoo responses of a sort from the BanK of Scotland on both my claims

On my current account they have appologised for not responding by the 8th of may and will respond by the 6th of June......

On My Bill Payment acvcount they have sent a standard letter saying that the charges have been applied legally and therefore they are rejecting the claim. I am going to send the next letter and threaten to take them to court on this one too........

It seems that they are rejecting new claims in the hope that the customer will bottle it and not go any further with their claim......

I got a reply from Halifax telling me they are not paying back the £2000 in charges. I rang and asked why they have paid out some peopel and not oters, they tell me it was a gesture of good will. What do I do next? can any one help? thanks Drew

Hi Drew35,
This is them just stalling for time. I am with the HBOS and have been fobbed off so many times. My first SAR for hubbies business account was sent on 16th January. I was originally using a representative and had enclosed a letter of authorisation for him to act on hubbies behalf. They waited until the 40 days were nearly up, then wrote advising that they could not proceed with the SAR as they needed a letter of authorisation!! I have since decided to proceed on my own and asked the FOS where to send second letter requesting repayment of charges.They told me where to send it and as I hadn't had a response after 14 days, I phoned to enquire and was advised that I had sent it to the wrong place.!! A call to the FOS advised me just to send it to the address the BOS had said, but to advise them that the FOS would be taking the date from the date of the original second letter ie. 14 days earlier. I think they are probably either hoping that this will put people off, or are stretching it out until there is a decision made regarding the amount to be set for charges. This way they will only have to pay the difference. Don't be put off, Regards IZZY

Read Martin's article and use the template there for the letter before action and if they don't respond to that you then start court action.

Hi,
I have called the bank and they have taken this months bank charges off as i was overdrawn. However i am in the process of reclaiming 5 years of charges.
Will them repaying this months charges affect my large claim in any way??

When I take court action through MCOL, once the papers are issued to the bank they are deemed to have been served after five days. Is that five days straight or five working days? I win if they do not acknowledge within fourteen days. Is that fourteen working days?
