    Hi,
I have called the bank and they have taken this months bank charges off as i was overdrawn. However i am in the process of reclaiming 5 years of charges.
Will them repaying this months charges affect my large claim in any way??

    Thanks!!

It shouldnt have any effect on your claim, so continue with the claim.

After waiting 9 weeks for my statements, I rang HBOS last sunday to demand my statements before I reported them to the Information Comissioner.

I recieved my statements on thursday (funny that!)

I have now sent my letter, demanding the total (inc interest) and sent this along with my statements highlighting the charges and sent them recorded mail.

I will now need to wait 14 days for reply (ill wait and see what excuse they come up with the delay this)

When I take court action through MCOL, once the papers are issued to the bank they are deemed to have been served after five days. Is that five days straight or five working days? I win if they do not acknowledge within fourteen days. Is that fourteen working days?

Last post in the Reclaim Help Thread which is linked in my signature gives the MCOL timings.

I hope you sent the bank copy statements as you should really send a list/spreadsheet of your charges as your statements will be required as part of your defence should it reach court stage.

I'm not sure what you mean by the above but if you are claiming in Scotland for a larger amount than £1500 you should get in touch with the Financial Ombudsman as they will take on your case.

    Hi,

I need some advice. I have followed all the adive and sent off my first letter to which I received the normal "we are dealing with your complaint" reply so I sent off the next letter..............they then sent a letter saying they would reply before the 25th May. I received a reply on Saturday which gave me a printed list of 4 charges from Feb-March this year. I hadn't even asked for this am completely baffled why they have sent this to me!!

    What should I do now?

Just stick to the timescales and send your letters by the correct dates. I dont know what half these banks are playing at - think its just another tatic to stall people. Carry on as normal.

And anyway if you have listed your charges you wont need the letter that they have sent so just ignore it.

Remember stick with your timescales not theirs!!

Thank u, I had originally given them until the 25th of May to reply so I have added on a few days for this one so that they have 2 weeks!!

    It's so irritating though:-(
