Hi folks, apologies if this has been covered before but I wrote to HBOS using the registered address in the help thread asking for my charges back on the 3rd of April. As I hadn't heard anything as of last week I thought I'd send them another letter reminding them that their 40 days to reply were nearly up. Anyhoo, the deadline passed on Sunday and I still haven't heard anything yet. What number should I call them on to check on their progress?

Yeah I photocopied them all, I kept the photocopies but sent them the originals (with charges highlighted) Do u think that will be ok?

Has anyone got any experience of dealing with the Bank of Scotland (not the Royal Bank of Scotland which has its own thread).
I recently sent of an adapted letter to them and I received this response today:
I am sure you will appreciate that like other organisations we incur costs for administering your account for late/unpaid payment or overlimit situations. The Bank believes it is fair to pass these costs on to the accounts affected, rather than absorb them into other areas of our organisation, penalising all our other customers as a result.
HBOS clearly outlines our charging policy in the Terms and Conditions that apply to your account. In addition we are committed to complying with the Banking Code, which sets out standards of good banking practice for banks and building societies follow when dealing with personal customers.
In view of the above, I regret to advise I am unable to refund the charges in question as they were applied to your account as per your original agreement.
I trust this clarifies the situation. Should you require further assistance, please do not hesitate to contact our call centre on the above number.
Is this them just putting up a smokescreen and hoping I will go away? Is it best just to send of the second letter threatening court action. Has anyone done this with BOS?

May I be permitted the observation that posting in two places makes it very difficult to give a full reply to both bits.
Having said that, the letter you have received is the usual standard load of b*ll*cks. Its very well written, though.The acquisition of wealth is no longer the driving force in my life.0 -

hiya celticstar.......I have sent my 2nd letter to HBOS and thier deadline is on friday and not a peep, but sticking to my deadline, which seems to be strongly recommended, and if it passes send the letter threatning court procedures, but.... if you have a contact number for the key office then give them a call.......I am gonna do it tommorow, will let you know how I get on ok, but either way, if they dont come forward with MY money then its going legal with the letter template that is on this site..........gonna fight it all the way.........the way I see it .....its OUR money, if we stole if from them we would be doing jail time, so why should they get away with it..........it costs them buttons to do these charges, so why should they charge so excesively ???? good luck celtic star, and will let you know how I get on tommorow ok, take care, and STICK TO THE TIMELINES !!!!!!!! xxxxxx0 -

Thanks Cuddly, what a nice post. I will keep you posted (no pun intended) as to my situation and would be glad to hear how you get on as well. Good luck tomorrow. I agree about the charges. Late charges didn't even generate a separate letter in my case, they just printed on the next statement that a payment had been late! How can you charge money for that? Take care.

Not quite sure what you mean. My original post has been merged into this thread as I didn't know that BOS was part of HBOS (you learn something new every day). I have posted something else elsewhere about a separate issue -ie the amount of the charges and whether the amount of charges is likely to affect the outcome - but that is a more general query and not really suitable to a specific lender thread.

From what I have read here others have had a letter saying that the bank will defend the claim, but in the past they have settled before going to court. In the light of the Kevin Berwick judgement I am not sure what course of action they will take.
