    Hi All

    It was the 25th of febuary that I sent off for statements for both my accounts. I had to bully and cajole the Bank Of Scotland into giving me them though.

    On the 10th of April they sent me a letter acknowledging my complaint for my current account. I phoned them last week and was tild that I would have a response by the 8th of May. So I phoned them today to ask what was happening and there is nothing on my notes saying that my claim had been looked at. SO I VERY MUCH DOUBT THAT I WILL RECIEVE A RESPONSE BY THE 8TH NOW. I was going to go to the MCOL site and start a proceedings against them, but as I am noving house right this minute (well actually I am Typing at this minute) then can't afford the fees......

    Interstingly though the option for complaining about charges has been taken off the customer services phone number. I got through very quickly but was completley unimpressed by level of customer service I got from the call centre, even though I am always disgustingly polite to contact centre operators (I know what a horrible job it is).

    So it looks like they will take the full 8 weeks they have from the FSO to respond to any claims.

    My other account has been a hassle to get statements for and finally got them at the end of last week. They recieved my claim on Monday and have yet to respond.

    Finally I got a nice letter yestarday from them providing me with a partial list of charges I have paid on my current account, saying that the rest of the data I requested will be sent under a seperate cover!!!!!!

    I have a feeling that Scotland will be independant, and I will be living as a exile living in fear of the English Immagration service before I see any Money.

    :confused: Hiya all,

    I've sent off letters 2 and 3, back in March giving them 14 days to resolve, have been sent 2 holding letters asying will have response by 31st May, should I wait as it will have been 8 weeks or should I start legal proceedings? And also i now live in England but have sent the letters to BOS in Dunfermline not Halifax so don't know whether i have to go through small cliams in Scotland or England.

    Please help I'm really confused and would love to get this sorted out.

    When I reclaimed (Scotland) I stuck to my timescale + 1 week extra.
    I sent them Court Summons, claiming back £750 each time (Small Claims limit in Scotland).
    I did this 5 times.

    They caved in each time and I got all my money back + interest.

    So, send them the next letter.

    Update.

    Received a letter yesterday from Bank of Scotland, thanking me for my complaint(!), saying they are sorry to hear of my complaint and that a colleague will be fully investigating my complaint. Time scale? 4 weeks. If, in that time, they are unable to respond fully within the 4 weeks, they will write to let me know! My letter threatening court action is due on Monday coming.

    Now, I realise this is merely a stalling tactic from the bank. However, I know they have a backlog of people claiming charges so my query is: Do I stick to my timescale and press on with legal action or do I wait the 4 weeks, my thinking being they will perhaps be a bit easier to work with if I don't pester them?

    I think I know what the answer to this will be, but thought I'd ask anyway. Any advice would be grately appreciated, particularly from anyone who had been in the same situation.

    When the 4 weeks are up they will say that they have 8 weeks to respond according to the FSO rules!!!!, I don't think that it is a delaying tatic as they are genuinley inandated with claims :D, and that coupled with the fact that they seem to be incompitent (or at least uncaring) things are taking longer than they should.

    If I had the spare cash right now I would take them to the county court, cause any opportunity to stick it to the man (or bank in this case) should be take.

    As you live in England you can start your claim online using MCOL using the English court system. When it comes to filling in the bank address use the HBOS address in Halifax and you'll be okay and yes you can start the court action now, don't wait the 8 weeks.

    Hi there,
    I wonder if anyone can shed any light on what has happened to me. I have posted before.

    I sent prelim letter to BOS (as I had my statements) on 2/3/07.

    I then sent LBA, on time on 16/3/07. However, I did not issue legal proceedings on time because:
    my claim is for £7,048,+, at court, interest of £900+ and the cost of issuing of £250 is more than a month's disposable income for me. I have also issued 6 other claims, using my two credit cards to pay for them - eahc card did not have £250 in full on it for the BOS cliam, but did have enough to start the smaller claims at £30 to £80 a time.

    My correspondence with BOS has been to receive two holding letters. Their 8 week investigation period was up on 3/5/07.

    From reading threads here and on the CAG site, I was aware that Halifax (people often mix the two up, so I'm never sure if Halifax is used to mean Haliifax, Bank of Scotland or HBOS), often offer after the date for the LBA, so although I would have missed out on the interest by not going to Court, I decided to wait for the 3rd of May to see what would happen. Today, I received their final letter - which basically dismisses my claim in full and offers me nothing!! Not a penny, no goodwill gesture, nothing!!

    I had noticed a couple of instances of this on the CAG website, but am now wondering, has this happened to anyone else? Is this a new tactic from BOS, or Halifax , or both!

    I am now prepared to issue my form N1 when the Courts open on Tuesday - but, as I have not got the cash I will have to apply for remission. I tried to do this before, but was refused - even though the point is, that if you can't afford to pay the fees you have no access to justice, the whole point of the remission procedure!

    Can anyone shed any llight on any of this?

    I just called Bank Of Scotland (for the 3rd time) to find out why I have not recieved statements.

    I went into my branch on March 20th to request statements from 2002-2005, I recieved statements from 2004-2005 a few days later (which was pleasing) and to date I have still not recieved any more.

    When I sopke to them tonight, I was told that the statemtnts can take up to 9 WEEKS for this information!!

    Can they Do this? does this not go against the 40 day rule?

    I have requested them again, so heres waiting...

    (however my friend requested hers last week and yesterday 10 envelopes arrived, funny that)

    Help please!!!!

    does Halifax have an email address? they still haven't sent statements..now halifax credit card sent husbands within a few days of first letter! but for my bank account..absoloutly nothing:confused:

    Hi folks,
    Thought I would stsrt this after a call from my very angry son:mad: :mad: The bank paid out a S/O on bank holiday Monday, taking his account over his agreed o/d limit, resulting in a £30 charge and a further fee of £28 to be added at the end of the month. His wages always go in at midnight on the Monday evening, but due to the holiday, they were a day late. He thought this wouldn't be a problem as the S/O would also be a day late. He phoned to querie about a S/O being paid on a bank holiday and was advised that yes this can be done! He then asked that charges be returned and was politely told NO!! So he politely asked them to forward his statements for the past 5 years and was advised they would be with him within 40 days. I have sent an SAR letter as a record of his request, so as not to give them any excuse to say ''there's nothing on our system''. The amount of times I have heard that statement in the last couple of months with my 2 claims is unreal!!

    No, Do not let them mess you around, they are hoping you'll just accept what they say because they are a bank.

    Send the letter totalling your charges and demand repayment, if they refuse which is where I am, then another letter making an offer can be sent.

    Im doing this but I'm not knocking down the amount drastically. they have exactly 14 days from receipt of the letter to respond and pay or it's court. No messin, your the boss they are trying to bluff!
