Just an update, the wife phoned up today and requested where the bank charges statements were? They said they don't have any record of any request by letter.
Anyway, the wife told them the name of the person who sent the reply letter and they said they will email that person to send out the statements within 14days. Well, the wife replied if you don't we will be taking them to court.
Will inform you what happens.
I am still waiting for my statements on my bill payment account if they are not here by friday I am complaining to the data commissioner and the banking onbudsman. My partner is with the HSBC and she got a settlement within a month of writing to them. I am sick of the amount of waiting I have had to go through with the BOS, they have had enough chances from me to make an offer on my current account and actually send statements from my bill payment account.
I am going to start court proceedings against them on monday on my current account anyone got any idea how much a claim for approx £1400 plus interest will cost at the MCOL site? "I'm Just A Demin Boy"

I have followed the advice given on how to reclaim my bank charges, after a 4 week wait I recieved a letter giving me my default charges, I used the template given and added interest then sent it by registerd post to my bank. Today i recieved a letter which states that having fully considered my request they are unable to make a refund, under the terms and conditions of the bank account the bos can levy charges when there are unsifficient funds to cover items. It goes on to say it trusts customers understand these conditions and that I entered into a legally binding contract and that the bos has not made an error.
Do I continue or give up...... these charges were all for unpaid dd and a couple of cheques.
Any advice would be greatly appreciated.
Continue read Martins advice. If I was faced with this I would immediatley file court proceedings against them. as you have given them a month to respond to your request and they have not so you are perfectley entitled to do so. "I'm Just A Demin Boy"

Hi all,
Funny, after the phone call was made yesterday a letter with the list of all back charges arrived this morning dating from 2001 to 2007. they must have panic.
Anyway, I have calculated the last six years and it all adds up to just over £3k.
The next letter stage will be sent out.

Has anyone had experience of reclaiming bank charges from the Halifax and / or Bank of Scotland?
We have two bank accounts Halifax and Bank of Scotland and both are suggesting it could be months before they acn respond with statements, look at the claim etc. due to the sheer volume of claimants recently. Their workload has apparently increased from 3 or 4 a week to 3,000 or 4,000 a week ... which says something for their ovrcharging eh?
We are looking to get our refunds as soon as practical as my wife and I are both ill, on benefit and the windfall of a refund of charges would be great!
So, if anyone has reclaimed from the Halifax, or Bank of Scotland lately and can indicate how long it took them start to finish a response would be appreciated. Thanks.0 -
A few weeks ago we started MCO for the total amount of 4118.26, a week later we received a letter from HBOS offering us the total amount of 2161.00 which we declined due to being approx: half the original amount we were requesting. The letter stated that if we do not wish to accept, then to phone them, otherwise if we do not phone they will assume we wish to accept the amount on offer.. Instead of phoning, we put our decline in writing and recorded it before sending, which we thought would be fine, then this morning while checking our bank account, I notice the 2161.00 was in our account from the HBSO, does anyone please have any advice in what we should do next......
Many thanks once again in advance..HBOS £4118.16 in bank charges
Paid 15th May £4118.16 woohooo:rotfl:
CAPITAL ONE £160.00.. 3rd letter sent
Paid a week later :rotfl:
Many thanks to Martin and everyone whom has helped :T xx0 -

If you really dont want this money, even in part-payment, you could always go in to the bank, withdraw it and hand it back to the cashier to dispose of. They have it in writing that you do not accept so I would back that up with a phone call and insist on written confirmation that the money has been completely removed from the account.0 -

Unfortunatley the answer to that is how long is a peice of string it took me a month and a half to get all the statements from my accounts. My current account claim for (£1400) has been in the system for 4 weeks and no response yet. I am at the stage of being ready to issue proceedings against them for that one, but as My daughter is starting nursery and we are moving house I can't afford the fees so it looks like they have a repreive for that one. I just recieved the statements for my bill payment account neary two weeks after the 40 days they had to supply them was up, I only acheived this as a result of tenaciously following them up.
So a short answer is that I would not expect anything this side of 3 months, and to be prepaired to issue court proceedings. "I'm Just A Demin Boy"
