I sent off my letter 23rd march they sent me a letter within two weeks saying that they where sorry for the complaint,they would resond if not in four weeks by eight weeks. as this is what the ombudsman suggest.. so we are both in the same boat. let me know how you get on0

Hey everyone,
Got a reply today for my 1st request for repayment. It was the standard "we have 8 weeks blah blah" that people seem to be getting.
My question is do I reply telling them no, I am sticking to my timescale and will add the court costs to the claim, or just go ahead after the 14 days and start the court procedure without further correspondance?

I am reclaiming from bank of scotland, but unsure whether they have 14 days from the day the letter was posted or 14 days from when they recieved it. Seems they recieved the letter 5 days after it was posted!!:rolleyes:
Also, The account I am claiming from was my direct debit account and there are a few charges that were refunded from the companies debiting the money as it was their mistake, do I need to deduct these from the claim total?0 -
From reading around the site I think I worked this one out.
I am in the same position. Opened my Halifax account in England, had difficulties after I moved to Scotland and then returned to England. But basically you use the law of the country you live in. So if you live in England pursue them under English law. It's where you live that counts.
(And if you don't live in England, see about getting an address there!)

What should I do next? I sent the first letter to Halifax Bank on the 19th Feb 07, they sent a letter back (just before the deadline on the 19th Mar 07) saying they would be dealing and sending the statements for no later than 10th April 07.
Well, it's the 19th April 07, should I give them a call?

Give them a call they do have a horrendous backlog of stuff to go through, it takes about 20 minutes to go through but it is worth it. they will normally promise to get statements out in 7 to 10 days once you let them know.:beer: "I'm Just A Demin Boy":beer:

Received a comunication from the BOS this morning in relation to a claim on Credit Card Charges.
To demonstrate our commitment to you I am prepared to offer you a refund of charges to the value of £100.00. representing all the charges applied to your account. Unfortunatley you are not entitled to claim back any charges for £12.00 or less, as these charges are deemed to be within the law and therefore will not be awarded by a county court.
Oh all right, if you say so it MUST be true :rolleyes:Halifax: claimed £1,028, received £1,028

Co-Operative Bank: claimed £560, received £575
BOS Mastercard: claiming £184, 2nd letter sent 27/3/07

I think they are refering to the OFT's statement on Credit card charges which set a limit of £12. Their has been no such judgement on Bank Charges yet:beer: "I'm Just A Demin Boy":beer:
