that's what I did - and I received all my statements - AFTER sending 1st letter to "The Mound" - Rosyth (Customer Services) then copies to Leeds, THEN went into a local branch.I am owed a STAGGERING £25,864.38 by HBos!0 -
Wow, long night reading a very long thread! I think I'm pretty informed on what to do and I thank all those who gave details of their claims or posted advice. Most useful.
I do, though, have a couple of questions:
1) I intend to claim against the Halifax. Regarding parachute accounts would anyone consider my second account with Bank of Scotland to be safe or is it wiser to get a new account with another bank entirely?
2) My understanding is that charges after 2004 would be after the HBOS merger and manually handled (and thus they are not obliged to record them). I am applying for a refund of charges from before 2004. Is it true that the bank would at that time have had to record the charges? (The only reason I ask is that I don't fancy trawling through six years of statements to identify the charges!).0 -

I would get a parachute account with another bank altogether I have a basic bank account with Barclays, and when all this is over with i am not going to stay with The Bank of Scotland, due to ther appauling customer service. I mean finding an address to write to that gets a response was near impossible, that is not what I call good customer service at all.
It was quite easy to trawl through my statements looking up charges over the past six years. The bank is obliged to provide you with statements if you ask them, and any charges are listed on them as being charges. So it is not as daunting a task as it seems.:beer: "I'm Just A Demin Boy":beer:

Maybe one of you clever people can help.
I'm with Bank of Scotland (2 accounts) but now live in England. My charges (£2 - £3K by my estimation without the interest!) are split between the time I lived in Scotland and England.
Should I claim in Scotland?
Have been looking at the Govan Law and CAG sites (which have given me more hope about a successful claim in Scotland - to be honest the thought of splitting and attending court had me wavering for a bit) BUT still feeling a bit confused!!!!
I'm waiting for the bank statement info so hopefully will be ready to make the claim/s soon :j

I am in the same position. Opened my Halifax account in England, had difficulties after I moved to Scotland and then returned to England. But basically you use the law of the country you live in. So if you live in England pursue them under English law. It's where you live that counts.
(And if you don't live in England, see about getting an address there!)

As Zelie says, you live in England or Wales so you can claim via MCOL and claim back 6 years charges.
One thing to note is you must use an English address for the bank you are claiming from as well so for HBOS use the Halifax address and not the Edinburgh address.0 -

Been in England for 2 years now so bank has my English address but bank accounts are still at Scottish branches (not Halifax accounts)
Thanks for that BUT done a lot of reading myself and worried about mentions of "winning" but banks not forced to comply with rulingfrom another legal system.
Does anyone know if BoS contracts come under English Law - been through a lot of paperwork and BoS web but can't find the info.
Plus anyone know the best addresses to use
For Scottish claim is Rosyth the best one? (I have 2 accounts at different branches in Edinburgh)
If I claim in England do I write to Leeds? Or is this only for Halifax accounts?
For the statements I sent letter to The Mound (Edinburgh Head Office) Am I in for a long wait? Also a bit confused by some of the posts regarding statements pre and post Halifax merger.
Any help very welcome - and sorry if I'm being a bit thick!
