I sent HBOS the letter requesting statements then had a reply saying they were dealing with it. The next day my statements turned up but only dated til oct 04. I called the number on the letter asking where the rest of them were and was told I had received all statements up until Halifax and BOS had merged and the more recent statements would come from a seperate address but had already been requested for me and should be with me within the 40 day limit. I was told this normally takes 10 days but will be closer to 14 days as there is a back log. Now I posted my original letter on 07/01/07 and its now 11/02/07. I thought they were sailing a bit close to the wind here so decided to call the number on the letter they sent me to hustle them on and remind them that 40 days is nearly up. I called the numebr 01422 391152 this morning but all you get now is a message saying " you are being trasfered to a message service that this number does not subscribe to this service. Goodbye!" then it hangs up on you.
Does anyone have an alternative number I can call?
If not is it the day I posted my original request for my statements that starts their 40 day time limit because I'm going to report them the second I can to the information commisioner.

Just about to post off a second stage letter claiming around £4500 spread over 4 different accounts with the Bank of Scotland. Managed to bypass the first stage as my husband and I are sad individuals and just happened to have bank statements going back to January 2002 at home, so have spent all weekend sifting through them calculating charges applied to each of the accounts. Will send directly to Head Office and will hopefully receive a reply within the requested 14 days. Will let you know how we get on.

Have just downloaded the letter templates and will be putting my claim to them tomorrow! I had called to say that my work had not put my expenses (£600) in on time and that the first I knew of it was three seperate letters through the door this morning from BofS saying that they were going to charge me £30 for 3 processed payments which my balance did not cover. Explained that I would transfer some money into my account tomorrow and could she cancel the charges as it was a genuine oversight and that my account had been managed well for years.
She said no so I asked her would it make any difference if I spoke to my branch manager direct to which she hastily replied no!!
I replied that I might just take it down the legal route and she actually laughed and said go ahead.
Well, wasn't that a mistake...... instead of waiving £90 of charges just this once, after visiting this site for info I have now been and looked out my statements from ages ago 4-6 years (when I was a student/unemployed) and from the few statements I have found I think I may well be able to claim back something around the £2000 mark.

Today i requested judgement by defualt for the Bank of scotland
Does know one know how long they will take to pay up?
also i heard bank of scotland are very quick at paying and for them letting it go this far isnt like them as they normally acknowledge days before deadline.0 -
New boy, so please be gentle, I know someone has already mentioned an address for their customer relation dept in Rosyth. I wrote to the address on the cheque book (South Gyle Cres. in Edinburgh) obviously marked for the customer services people..
Does it matter that the original letter went to this address and not a head office. ? we wrote to them about 3 weeks ago, and havent even received an acknowledgment from them.
I obviously dont want to give them any excuse to wriggle out of things..
Oh, by the way our scores on the doors are ..£1150.00..please feel free to email with any tips etc or I'll watch this space..thanks again and good luck to you allsomeone once said to me "cheer up, things could be worse !" so I did cheer up, and he was right, they were worse !!0 -
If your letter was your first letter claiming then sending it to your branch is fine. Addresses are listed in this thread.
As you haven't heard from them in three weeks I would follow up with a phone call now to make sure your letter got to the correct department.0 -

A note of caution - i requested judgement by default against BOS last monday at 9.00am. Two days later it was rejected as they'd acknowledged my claim and now have an extra 14 days before filing any defence. It seems the courts will let their acknowledgement override your request for judgement even in a few days have passed... This is covered by Martin in the main thread.
So hold on! I have until Monday to hear if they've filed a defence - then i'll be hitting that judgement button again...

HBOS have just paid up £5377 two days before their 28 days (they acknowledged on MCOL) was up. They didn't write or call, just credited my account.
So the advice is, with Halifax/Bank of Scotland, don't wait for the post or the phone call, try checking your account online.

I did exactly as MSE suggests: 2 letters to Bank of Scotland HO in Edinburgh, i received one saying that they were looking into it and would reply in 4 weeks. Didn't wait for that, just went ahead on MCOL and issued 2 claims (using the Trinity Road, Halifax address) - i am also claiming for a closed account - they acknowledged the claim just before on the first claim and just after the 14 days were up on the second claim which meant i had to wait until 20th February before next action. However, i checked my bank this morning (just in case) and to my amazement the money was just in there for the first claim. I have had no other communication from them so I am assuming that my second claim for £830 will be in my main account any day...
Advice is just to go for it - I honestly expected to be on the website as the one person who went to court and lost - I cannot believe they've just paid up. I'm now going for the credit cards.
