Hi all,
Am new to this site and would be grateful for your help.
I have received a letter back from HBOS with regards to my request for statements / bank charges and they state the following;
"if you requested information relating to manual intervention on your account, I regret HBOS plc is under no statutory obligation to record this information and therefore, I am unable to assist further with this request"
They have sent me all statements with all bank charges omitted and this causes me a problem as I dont have a record of all the charges of the 6 years.
Now, I have done a search on HBOS manual intervention on this forum and unfortunately there is no direct response as to what to do after receiving this letter. I can't sit tight as, surely, I need to know my bank charge costs over the years in order for me to reclaim.
HBOS are not saying that they dont have the records. They are just saying that they won't provide them to me. I used the 1st letter on this forum and used the DPA wording.
I would really appreciate your help on what to do now in order for me to proceed my claim.

There are two different issues here, firstly Manual Intervention:

Secondly, the charges should have been on your statements. This is what you asked for. This has nothing to do with the Manual Intervention. Tell them unless they comply with the Subject Access Request and provide a list of charges, you will report them to the Information Commissioner and enforce in court if necessary.0 -
hi there, i recently sent away to claim back charges from my bank, i currently have 2 accounts with the bank of Scotland so added up the charges for each account and sent away in separate envelopes ,recorded delivery on the same day, bout a week later the bank wrote back saying they had received the first letter.
but a week after that they wrote back saying that was them just receiving the second even thou they were posted on the same day?
anyways... i recently received a latter saying they were happy to offer me the full amount off 344 pound for one of the accounts and that i need to send the completed form in to get the money back, but states once i do this i cant claim anymore charges back,
im puzzled if i do this and send to get the 344 from that account will that mean i wont get the 560 pound of charges from the other account which i sent away for also?
just the way its worded i wasnt sure
any help would be greatly appreciated

If it only mentions one account number it should not affect the other claim. Before you sign any acceptance letters you should cross out the part anyway where it says that you cannot claim any more charges after this.Reclaimed thanks to this site:

Hi, just an update on where I am (or am not) with my claim against HBOS
Wrote asking for refund of £7,402 of charges on 2 March 2007. Received an automated complaints reply letter two weeks later - saying the standard, we will take up to eight weeks to reply.
Sent the LBA on 18 March 2007.
Today received another holding letter - dated 2 April 2007, saying 'we're still investigating your complaint, and you will receive a response from us as soon as possible, but certainly no later than 3rd May 2007.'
I now need to file with MCOL, but have had to delay as the value of my claim makes the Court costs too much for me to pay till the end of April. I will however keep you posted and let you know if I hear anything more.0 -

just checked my bank and the bank of scotland have put the whole 1,444 into it a big shocker there for me.
can anyone help my court case is due on 10th of may the bank have to reply to court by the 3rd of may do i just leave money in my bank without touching it and hope for them to go as far as court so i get my court fees back which were £65 in total plus all my interest please help.........0 -

As you have filed at court you are entitled to your full claim + interest + your costs so you need to write to the bank and say that you will accept the money in partial payment and without prejudice but will be continuing with your court action.0 -
