    Recieved a letter today from HBOS advising that they woulf offer me £200 for my claim of £453

    Called the number stated on the letter and said i would accept an absolute minimum of 75%

    Lady i spoke to advised that it will be passed for further review and i will hear from them shortly.

    How is everyone else getting on with everything.

    Still waiting on word back from the bank accounts which they have untill 14th.

    hope they do get back to my quickly about this as my first lertter was sent back in november.

    Hi all fellow p'd off HBOS customers.

    Issued MCOL claims against Bank of Scotland £5800 and £800 and they filed acknowledgements at the last minute so now i have until 20th Feb to see if they file their defence.

    I'm intrigued as to the famous phone calls that people are getting. I want one! HBOS seem to have no consistency whatsoever.

    I live in England and have filed against HBOS in Halifax. Anyone one step ahead of me yet?

    first post, and am very despondant :(

    I followed the procedure outlined on the webpage, and on monday sent a letter via recorded delivery saying that the charges were unlawful and if they didn't reimburse me we would be going to court, and they sent a letter back saying the following:


    *********************************

    "I'm sorry you have found it necessary to contact us regarding charges on your account. Like other organisations HBOS incurs additional costs when an item is returned unpaid, or paid against an unauthorized overdraft. Rather then pass on these costs to unaffected accounts, charges are applied only to the overdraft concerned, so we do not penalise all of our customers. These charges only partially cover the costs we incur and compare favorably to our competitors

    Our charging policy is clearly outlined in the T&C that apply to your account and I enclose a copy of these for your reference.

    You will find a leaflet outlining halifax bank account charges for your perusal and a copy of our leaflet explaining our complaint procedures and the help the Financial Ombudsman Service can provide should you have any concerns.

    Should you have any concerns which remain unresolved please do not hesitate to contact me at the branch on XXXX XXXXXX when I will be happy to discuss the matter.

    If I do not hear from you in the next eight weeks, I will assume you are happy

    Now i just dont know what to do. Is the inclusion of the bolded part above a sign that he will negotiate, and if so, what the hell do I SAY! and if not, does this mean I have to go to court? I really wanted to avoid that =((((

    If anyone has any advice, I would love to hear it

    Recieved letter yesterday saying as a good will gesture they will offer me £410. Im claiming for £678. This was recieved after sending off my second letter (before action).

    As tempting as it is to accept, i will be waiting until tomorrow (a day before im due to file the claim) and ring them up to 'discuss this matter'. Politely ask them for the remainding money or i will file the claim and remind them that they will then be liable to pay court costs plus any interest.

    This is a standard letter. I got the same and see my post above.
    Stick to your own time scale (14 days) and send them the second letter stating you have recieved an unsatisfactory response therefore you have 7 days to reflect otherwise you will start a claim reminding them they will be liable to pay any charges asked for, interest and court costs.

    They should then make you an offer providing you have followed the correct procedure.

    I got this response after sending the second letter, they never responded the first time round!!!! In this letter (sent on monday) I said 7 days and then court action, so it seems like they are just writing it off completely. I thought I would at least get a settlement offer!

    No idea what to do, am hoping one of the fine people on here has advice to offer.

    The statements came through quite quick for me but the longest period has been HBOS stalling with this 8week policy the supposidly have to deal with a complaint.

    As i said above i eventually had an offer from them of £200 i called the number on the letter and said that i was looking for at least 75% of my total charges on my credit card.

    I then had a letter through the post 2 days later with a further offer of £400 which is all the charges as i had one refunded and a £12 one refunded over the last year.

    So you do end up getting the full ammount but they do try anything just to stall and to lower the offer to see if people will take it.

    just one left for me now.

    Biigest one too lol :)

    Waiting on the offer from HBOS regarding my student account and current account which ammount to nearly £1000

    Have you sent list of charges with your letters?
    It seems your one of the ones they fob off. Not been to court myself but if you have done everything properly and proof you have sent letters etc.
    I would give them a ring stating your not happy and that you intend to start the claim. You have nothing to lose here so if you get a negative answer then you will have to file the claim..

    I would not worry about doing this.. At the end of the day you have to work for the money. They are not just going to give all of it all back after just 1 or 2 letters etc. It might seem daunting and i will be in the same boat after a decline my latest offer. It might be the day before court until they settle but there is a risk of going to court. Do your homework about the court and you will be fine.

    yes, the first letter had a list of the charges, dated and stamped, asking them to refund my charges. They refused this, and then the second one was essentially the template from this website, and this included the charges again, plus the interest, and a seven day notice of court proceedings. The reply typed above was in response to the second letter.

    I guess I will give them a call and see what they have to say, the problem is I have no idea WHAT to say!! I cant just say "your charges are unlawful, monies plz".. which is why I am hoping one of the experts on here have some expeerience of what I need to do next.

    I would say send teh £10 to be on the safe side.

    you should get more than that back for your charges anyways :)

    I sent a £10 note lol and that was 3 different HBOS accounts.

    and they were fine with that.
