Thanks to you who answerd. Two days after getting the letter telling me I wouldnt get anything back from bos. I got another letter saying they would investigate the matter which would take 40 days I think. Is this just another delay tactic on BOS part. Should I follow through with second letter or wait? I am not sure whether I have to include the small claims note with the second letter. Would greatly appreciate clarification here.

I am new to this so bear with me!!
I am in the process of asking for £1500 back from them, I sent off my first letter stating how much the charges came to. After about a week I got a letter saying they were dealing with my complaint and this takes time.....
So, I sent off my next letter saying that the next step is court action. I waited a week and then I got another letter saying they were still dealing with my enquiry and would get back to me before the 25th May. Should I just wait till then or send another letter?
This money would help me so much, does anyone think this sounds positive from the bank?

I called up HBOS on the 14th of February and asked them to send me my bank statements from the last 5 years. I was advised that this service would cost £5.00, so I paid it there and then.
I have since heard nothing from them and have had no response to my letters.
I called them this morning and told them that I had been patient with them and waitied far longer than they are legally allowed. I then said that If I didn't receive the statements within 7 days, I would go to the Head Office and sit in their reception until I recieved them (I was getting fairly peeved by this point as the Customer Service advisor was getting snooty with me)
So, I spoke to a girl in their complaints department who told me that the statements had been sent out over 3 weeks ago and must be lost in the post! "Odd" I thought, seeing as Royal Mail have never had any problems delivering my normal monthly statments or notice of charge letters!
So I asked the girl for the date of when they were sent out so I could complain to Royal Mail, to which she replied "I don't have a date of when they were sent, I only know from your notes (always with the 'notes'. I don't think they even keep bloody notes!) that they went out to you over 3 weeks ago.
So now i'm stuck.
She said that she would re-order them and I would have to wait another 3 weeks to recieve them "but with the high volume of people asking for them, it may take longer than normal". I don't see why I should wait! I have a good mind to go and do my 'sit in' and take a Scotsman journalist with me.
What should I do?! Is there anyone I should be contacting now?0 -

Firstly your not alone.
Go into your local branch, I did with Halifax (part of HBOS) and they didn't charge me a penny and best still they arrived within a week.
Don't forget to report them to the information commissioner as well too many banks are doing this and its not on.

They tried blaming it on everyone else but the milkman when I rung but they couldn't deny my summons hitting their post mat! hehe well brings a smile to my face0 -

Always start your claim off by asking for 6 years statements as its only when/if it comes to court that the 5 years kicks in plus there is always the option of using the Financial Ombudsman if the bank want to take it to court.0 -

Update.
Received a letter yesterday from Bank of Scotland, thanking me for my complaint(!), saying they are sorry to hear of my complaint and that a colleague will be fully investigating my complaint. Time scale? 4 weeks. If, in that time, they are unable to respond fully within the 4 weeks, they will write to let me know! My letter threatening court action is due on Monday coming.
Now, I realise this is merely a stalling tactic from the bank. However, I know they have a backlog of people claiming charges so my query is: Do I stick to my timescale and press on with legal action or do I wait the 4 weeks, my thinking being they will perhaps be a bit easier to work with if I don't pester them?
I think I know what the answer to this will be, but thought I'd ask anyway. Any advice would be grately appreciated, particularly from anyone who had been in the same situation.0
