KurtHamster - thanks also for your input. Your point is interesting. One of my earlier points was that the Bank could have instantly stopped me on MCOL because when they acknowledged service they could have said they intended to contest jurisdiction then, but didn't. They said they would defend all of the claim, then have paid up on part of it.
I don't know what to do from here - I suppose I'll have to sleep on it but I would appreciate any input or thoughts from anyone. Also, has anyone here used MCOL against BOS and how did they get on - I notice from the acknowledgement that the Bank sent they asked for all court correspondence to go to HBOS in Yorkshire, not BOS in Edinburgh.0 -
Further to my earlier post, I have now had a chance to actually work out what the Bank has paid and going by my calculations they have not paid me 5 years' worth - I reckon I'm about £188 short on one account and £466 short on the other. They have paid my court costs. I still don't know what to do though - I'm still kicking it about in my head.0

I've just received my statements from HBOS for the past 6 years. In addition to being charged for excess OD and unpaid DD's, i have also been charged a range of 20 to 28 pounds a month on top of other charges. These have been referred to as account maintenance charges - it is not a continual monthly fee, just whenever my account has been charged for something. Can i reclaim this aswell - it seems like double charging!!!!!0

Can anyone help please, I have gone through all the proceedures of reclaiming charges from Halifax/Bank of Scotland, and am 1 week from my 40 days being up.
I got a letter from them today saying they had looked at the claim and have rejected it as they believe the charges were correct, as per our agreement etc...
I called the number at the top and an advisor told me if I didnt accept this, they could re assess the claim which could now take another 8 weeks!
Any ideas of what on earth I can do now? I waited patiently for the 40 days (except 1 week) to be told it was all for nothing! My 40 days are up on 30th May, do you think they will write and make an offer at that point or will I really have to wait 8 weeks? If i go through the financial ombudsman they say it could take 3-6 mths and if I go through the courts it will be a lengthy process as well.
Any help/ideas would be greatly appreciated!

What 40 days? The bank gets 40 days for sending you a list of your charges, after that you send them a letter with a 14 days deadline and if no reaction comes (or one you don't like) you send another letter with another 14 days deadline. And then you take them to court. They seem to think that they can follow their usual complaints procedure which allows them up to 8 weeks to respond, however, you simply ask for your charges back, so that's a different scenario. I am afraid you just have to take the plunge and act now - either through a court claim or the FO, but the court route is quicker.Reclaimed thanks to this site:

They sent me the statements through within 21 days, then i wrote asking for the money back. they then wrote and said the FSA gives them 40 days to sort it out. I gave them the 40 days which is up next week, and theyve now written to say the claim was rejected. I called them and theyve now agreed to re-assess the claim but it will take a further 8 weeks to have another response? Im at my wits end0

As you can see by other HBOS claimaints they will keep putting you off, you now need to start your court action, send them another letter saying this is what you will do and give them 7 days, or wait the 8 weeks that they suggest.0

OK.
I sent my first letter to Halifax on the 04/04/07 asking for just 1 charge of £39.00 to be refunded.
They replied on the 07/04/07 saying they would investigate and get back to me within 4 weeks. They didn't
So I then sent another letter stating that it has been 4 weeks and I would like a update (I know under FSA rules they have 8 weeks).
A letter came in the post this morning and they rejected my claim stating that the fees were "fair" to cover their charges.
Do I file a court claim now?
I'm prepared to switch banks as it is only a savings account, I've already got a Nationwide account which I prefer although doesn't allow online shopping.

From the stories on this site, one thing for sure is that the halifax/bos are pretty regimented in taking their 8 weeks to "fully investigate" and then turn down our requests.

When its mentioned "14 days" in the letters, is that bank working days or a plain 2 weeks (I was told rather snootily that the 40 days "were bank working days" not calendar days.
