As I read it you only get to POPLA after suffering a full set of deliberately designed hassle letters. POPLA don't entertain you until you have the full set and a special number from the hasslers.
I found it easier to remove the pieces I wasn't addressing. And no I am not a bully myself, it is just that we who advise are people that the PPCs will not bully because they can't - we have the knowledge to turn the tables on them and such we do.0 -

This was not P&D but a free two hours with charge after that. The first fake PCN picture shows my car parked next to their sign while I step out to read it. The second picture is of my car parked in the street outside their car park. I drove onto the street and parked minutes after their first picture was taken. Simply did not like the contract the sign was offering.
Just for the hell of it I have now challenged the validity of their charge by email. And asked for better pictures and any showing the location of my vehicle between the first and last described above. I know when and where my car was all the time but no one other than me could tell from the pictures they sent. It was a dark night but the pictures are cropped down so it's as if they don't want you to be able to place exactly where the car was parked.
On a lighter note I know how to get you a PE PCN real quick. Just show your registration number in a certain place on the road outside their car park for just over two hours. The PCN will turn up within twelve days. There's a large four wheeled bin standing there just now. What fun and publicity it might bring to the cause with a PCN ANPR picture of a Biffa Wheeled Bin going to POPLA. Come to think I have a spare number plate off my trailor. :rotfl:
The "I'm alright jack" bit was how I might be perceived and certainly feel for not taking this on and ignoring it as someone suggested earlier.
Any idea what steps POPLA might take against them for charging me to park in the public street? I think it should go to them as a complaint either way - appeal to PE accepted or turned down.
Well then those photos are shocking if the second one shows your car out on the road - and this is well worth you appealing it to POPLA. By the way POPLA do not enforce sanctions against a PPC so no steps would be taken when your fake PCN is cancelled. POPLA is a new service designed just to make a decision on a 'case' - a decision which you can then ignore but the PPC cannot, if they lose that's it or they'd be in breach of the BPA Code of Practice.
If you want to complain you'll have to aim your complaint at the BPA who might impose sanctions - if they can be bothered - but they are basically an 'old boys club' of PPCs. So don't hold your breath!
And you can aim a complaint certainly to the DVLA to point out that PE had no 'reasonable cause' to get your data.
And a complaint to the Office of Fair Trading and/or your local Trading Standards (but don't ring them or you'll get a fob of central call centre). Send a letter & enclosures by snail mail to your local Trading Standards office.
And a complaint to your MP might cause a kerfuffle.
And exposing it in the local press like several of our posters have done to good local effect.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You say PE cant have cameras on entrances and exits because there are too many? Yet they have cameras that repeatedly scan the car park. I would have thought the latter method would far outweigh the cost of the former.
What is the secret with the location? If we could see it it may be clearer! Parkingeye are not the sharpest but I think they could work out which car park this is!0 -

Yes Highways WILL take action on this, I recently helped get a PPC kicked out of an estate because of a similar situation. A well known ppc on here had been told a certain estate was being adopted by the council so all the roads would then be council owned land.
The particular ppc still issued their tickets on the land after the adoption date, to which the council took a very dim view. They were ordered to take down all signage on the council land and cease ticketing unless they wanted a day in court.
Complaints to the BPA about them as well, the result being that they were told to cancell all tickets and refund those that had paid.

P.S. a google reference to the street or just a street name and location would help your credit, if this is a genuine thread then you have nothing to loose as you did nothing wrong ? PE can do bog all if its an adopted road.You may click thanks if you found my advice useful0 -

OP we can't really offer advice on this as you are to emotional and do not give facts, we need a google street view link, we need to know if this road is a public highway or private, ask the council. We need to know if these cameras do in fact point to the street, which I think they don't . It's more likely that you have entered this car park twice and they have done first in last out. I am not dismissing your claims out of hand, but I find them hard to believe sorry.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Surely if PE are recording and storing data on cars parked in the street they are in breach of the data protection act.0

Parking Eye or the BPA members code of conduct says they have fourteen days to respnd to my appeal. They will not discuss the details over the phone when I tried. Found a non-premium rate number for them. Person who answered was in Chorley but this number is for Preston 01772 450970.
Looks as if this could be fourteen days and nights of psychological harrasment. More so as this period will run concurrently with the period for which the charge is discounted.
So they can put me in this deliberately harrasing situation for two weeks or more asking for money I don't owe. All based on false evidence. And the law of this land and all those organisations who are involved offer nothing to get it stopped immediately?0 -
You seem to be taking this matter much too seriously. It's only a PPC we are talking about. They are not the police or the council. Just treat their so-called "threatening letters" as you would any other junk mail..What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

People do get emotional when accused of something they did not do and get a fake bill that big. Gets even worse when you can't speak to the organisation to explain their mistake and sort it out as two human beings. I give plenty of facts. Fact you don't beleive me is akin to accusing me of doing something I did not do or that I am wrong. Not a FILO on multiple visits. Stop saying "what we need is" repeatedly. You have no right to need anything of me - what I volunteer to give will come all in good time when sensible to do so. Assuming folk are pleasant and polite.0 -
