    Do you know for a fact if local highways have any power to take action? Under what legislation? Without that I could well be wasting my time there.

    Seeing justice done is sufficent. I don't think there is any need to "get back at them". If previous drivers caught out unfairly are compensated that would be great. If the dodgy practice is stopped once and for all that would also be great. If the fact they can't identify where their responsibility (boundaries) starts and finishes, legs them over then that's their problem for being either careless, greedy or both.

    If they continue to try and get away with charging me for parking on the street that will be a different matter.

    Not that it matters as it's an unenforceable invoice but surely the fake PCN is for driving in and out of the car park without paying for a P&D ticket? Doesn't it show pics of the car driving in and then out?

    Anyway, just appeal to Parking Eye with any wording you like and then when they reject they have to make the POPLA service available to you. You do not have to run the gamut of all their threatograms first, it doesn't take months.

    If you want to understand what Parking Eye 'should' do in terms of the timeframe for making POPLA available, skim-read the BPA Code of Practice which is easy to find online. There's a guideline about POPLA and appeal timescales there, I think you have 28 days to appeal PE and then they have to allow you 28 days when they reject, to take it to POPLA.

    No-one has got that far yet because POPLA only started on 1st October - for fake PCNS issued after that - so we'd need to be well into the end of November before the first person is enabled to use the new service, considering that timeframe I have just given. :)

    Either way don't pay it of course but calm down, you've no idea what level of complaints have been led by posters on here and on pepipoo and on Consumer Action Group; serious work and complaints in high places have been going on for months and years, long before you realised about this scam. Recent successes for us regular posters have included PPCs being banned from data access by the DVLA as well as the odd PPC Small Claim case defended well (with help from a forum) and kicked out by judges. We don't just come on this forum and type replies you know.

    The usual forums who are pretty much united against PPCs are very used to fighting this scam and we aren't of the 'I'm alright Jack' view at all, far from it. As well as things going on off-forum, we give up hours to help on this forum saying the same thing every day to newbies, and yes, often we still tell a 'post-Oct 1st' newbie to ignore it if they are not confident enough to do the appeal thing and cost the PPC money to fund POPLA.

    Clearly you are confident enough to appeal, so go for it, I would. In fact I am trying very hard to get a Parking Eye PCN to add to my collection and to try the POPLA process myself.

    thank you for taking the time to explain in a little more detail. I might well be one of the first to get to POPLA then. Test case with absolute guarantee that even if it goes to court they will lose.

    This was not P&D but a free two hours with charge after that. The first fake PCN picture shows my car entering. The second picture looks to be of my car parked in the street outside their car park. I drove onto the street and parked minutes after their first picture was taken.

    Just for the hell of it I have now challenged the validity of their charge by email. And asked for better pictures and any showing the location of my vehicle between the first and last described above. I know when and where my car was all the time but no one other than me could tell from the pictures they sent. It was a dark night but the pictures are cropped down so it's as if they don't want you to be able to place exactly where the car was parked.

    On a lighter note I know how to get you a PE PCN real quick. Just show your registration number in a certain place on the road outside their car park for just over two hours. The PCN will turn up within twelve days. There's a large four wheeled bin standing there just now. What fun and publicity it might bring to the cause with a PCN ANPR picture of a Biffa Wheeled Bin going to POPLA. Come to think I have a spare number plate off my trailor. :rotfl:

    The "I'm alright jack" bit was how I might be perceived and certainly feel for not taking this on and ignoring it as someone suggested earlier.

    Any idea what steps POPLA might take against them for charging me to park in the public street? I think it should go to them as a complaint either way - appeal to PE accepted or turned down.

    To be frank I'm rather bored of this one now - never seen anyone explain the situation so badly. I agree with ManxRed

    Not a wind up. You will have to withdraw that when it all comes out.

    Simple like the title says. PE sent me a bill for parking on the street.

    Did'nt know how significant all this was until we got into it. Kind of how threads develop. Realised by now at my age I'm no William Shakespear but you could be a little kinder to a newbie.
