If you want the full amount, put a claim in & you will get it. Do it by filling in an N1 form & taking it to your local court though, moneyclaim is terribly slow & unreliable, plus you can do a much more detailed POC on an N1 form. I can pm you a template
I did exactly this with bast**dcard & as usual, they paid in full. Also rejected their confidentiality clause in the settlement offer & they paid unconditionally. Check also your credit report. If they have entered late payment & defaults on it, you can demand they remove these aswell. If they do not, you can proceed to court to force their removal on the basis that they owed you money, therefore there was actually no payment due..0 -
hello all, could do with some advice on reclaiming cc charges please,
wrote to barclaycard asking for statements and info on charges on an old card (29/01/2001 - 22/07/2003) but they wrote back saying "the information you have requested has been deleted from ou main computer therefore not available - please write to customer relations"
i know i had 15 missed payments because its on my credit file from equifax and god knows how many overlimit charges.
any help please.0 -
6 months ago they cashed our cheque for our statements...still waiting. We can't afford court action though.0

Can I have some help please?
I contacted Barclaycard and asked for the statements and enclosed the £10.00, the statements came and I calculated from Martin's site an amount owed.
I sent the 1st letter asking for the money back.
Today I have received my original letter back stamped with received on the 4th Feb, with a compliments slip asking me to check the account number.
The account number is correct so I called them. After speaking to 3 different agents who couldn't even repeat my acc no correctly they then told me there was no recorded of any letter received by them and to write in again.
Excuse me but the letter is Barclaycard stamped as being received.
So do I just resent it stating the account number is correct or is the a stalling tactic.
If if is the later do I now send the second letter?

If you have proof they received your first letter, just move to the next stage.0 -

On my letter, the one they kindly returned to me, it is stamped with their company stamp and date of when received.
This is so annoying.

My advice to anyone claiming against Barclaycard would be to call there litigation dept as the person i spoke to told that they are settling all claims.

Hi all,
would really appreciate a little advice on my Barclaycard palava. I originally took out a barclaycard during my final year of university to cover rent payment for the first month of term (£240 - Oct 2005). Although I started off fine for the first few months, I soon forgot to make payments although I never used the card again to pay for anything else except this first rent charge. Inevitably, the late payment charges began to build up which quickly took me over my limit (£400), this of course exacerbated matters and doubled the charges, and being a cash strapped student I was unable to meet the escalating costs. I admittedly buried my head in the sand, not knowing what to do, or what my rights were.
My account balance reached around £770 by July 2006 and I paid a one-off payment of £368 to get Barclaycard off my back, but wrote to them a number of times to say that this was my final payment to them as I believed the extra costs were unfair and taking into account what I had already paid back to them in the months previous, I had far, far exceeded what I had borrowed for the rent payment in the first place and stated that they should consider this my final settlement. They wrote back saying they would waver £80 of the charges, but I still owed them over £400 worth of charges. Again, I wasn't sure what to do.....and yet more late charges and fees until they finally suspended my account at £637 and passed it to a credit repayment agency in March 2007.
I wrote to them again defending my case but my letters went unanswered and baliffs were been sent to my house/legal action threatened.....all to no avail.....until this week, when I checked my Barclays current account and realised Barclaycard had "exercised their legal right to set off any outstanding arrears owing on my Barclaycard account against the credit balance in my Barclays account". They have stolen £637 from my current account to settle the account. Unbelievable.
Sorry for the essay....I admit burying my head in the sand wasn't the best way to deal with these companies and I have learnt my lesson....would appreciate any advice on how to fight this.
