  • I have had a copy of the defence submitted by Barclays for my claim for credit card late payment fees and over limit fees. I am tempted to give the bank a further 4 weeks and have written to them to see if they will settle out of court. Must admit I am a bit scared of going to court. Has anyone been in a similar situation?

    Could I just pop in and ask something about this. You say they filed a defence! What kind of defence are the banks using, do they try and paint a bad picture of the individual claiming the charges or do they try and put a view across that their charges are fair etc?

    Hi everyone, I can't find anything relating to my situation so hopefully someone here will be able topoint me in the right direction.

    Barclaycard have (after three months) sent me (incomplete and poorly printed) my 'statements' and now say they are going to charge me PER STATEMENT £3 and just take it from my Barclaycard. They have sent me nearly seven years worth I can't afford that! Is there anything I can do?

    ANy advice would be greatly appreciated!

    If you made your request using the template letter in Martins article, they can't do this. The request should have been made under the Data Protection Act. The maximum they can charge for this request is £10.

    If you didn't use any template letters, and just asked for six years statements. They do charge for copies of statements.

    Defences are a little different, but generally the same. The defence can only argue against the case based on points of law. The court will not make any decision based on the type of person bringing the case. They will make any decisions based on whether the charges are in line with the law or not.

    I sent them a template, I think whats happened is theres been an investigation by the ICO on the !st dec to see if microfiche is covered by SAR and they decided it is unfortunately I sent my letter on the 28th nov oblivious to all this. I think I have found a template to send them.

    On top of all this although the charges ammount to over £200 they are actually made up of £15 charges and from what I've read its not even worth claiming that ammount.

    Thanks, I've contacted the lady who wrote the letter on this thread and asked her what the outcome was.. hopefully I won't have to for k out the £160odd quid they're asking for..

  • After taking the advice on this site I phoned to ask where my statemnets were after writing to them 3 times (all recorded delivery). The bloke said that yes they had recieved my letters but due to a "technical problem" the statements had not been sent, was this the same technical problem on all 3 occasions? Anyway he assures me that they will be here within 10 days and if not then just ring back! I am so looking forward to taking this all the way, they really have got me riled!! will keep you posted.

    Just wondered if anybody had a telephone number for them, I sent a recorded delivery letter asking for my statements and included a cheque them, but haven't heard anything and its over 3 weeks now. My a/c was closed quite a bit ago but I provided them with name, address, dob etc.
    I wished the buck stopped here as I could use a few!

    Not sure if anybody can help with this but any advice would be gratefully received.

    I had a credit card with barclaycard up until about 2003 and incurred some large bank charges at the time. Unfortunately i have since got rid of all the paperwork relating to this card/account thinking i wouldnt need it (always the thngs you throw away isnt it!!). I cannot trace the card number but would like to make a claim if possible as i was left severely out of pocket at the time. Does anybody know if it is possible to trace a credit card number/how to go about doing this?
