Well I was happy with it, just wanted to get rid of the card and have done now :)
  • Barclaycard have offered me £120 of the £300 I have claimed. As I'm doing pro rata payments with them, I think I shall accept and behave myself. I mean, I could argue that it wasn't "sensible lending" (or whatever it's called) for Barlcaycard to give a student a 4.5 grand credit limit but if they hadn't have done that, I wouldn't have been able to get through uni...

  • Ok, so yesterday I got a reply from Barclaycard saying that my account details had been deleted from their system, and they cannot provide me with any of the information I had request under the SAR!

I wrote last year asking for my records, they replied in January, saying that they could not find them. I responded with more information (bearing in mind my original letter included my old Barclaycard Account number AND a photocopy of my final statement!), got no response within the original 40 days and made a complaint to the Information Commissioner.

A week later, Barlcaycard finally responded. Saying information has been deleted. (I haven't heard back from the ICO yet - but that's only been 2 weeks).

So... what should I do? I'm sure Barclaycard would like me just to forget it. But that isn't going to happen.

Should I estimate how many charges I think were applied to my account over the 6 year period? If they contest any court action - wouldn't I automatically lose because I have no evidence to back up my claim? Or would they fact that they admit deleting my account info count in my favour?

I can go through my old bank statements and look at months I didn't make any payments - and would therefore incur penalty charges that month. Is this the best course? Help!!

Also, can someone tell me what the penalty fee for a missed payment was on Barclaycard between 2000-2006? (since I cannot see my statements they have deleted!)

Has anyone else had the records 'deleted'?

    Thanks in advance.
  • Give me a minute and I'll move this post into the Barclaycard thread as this seems to be a common problem with Barclaycard.

    Hi,

I already quoted that in my 2nd letter.

So, they've just ignored that. Hopefully the ICO will be able to force them into getting me my information.

So it's looks like this one is a dead-end? Bloody Barclaycard.

Hi Guys. I sent a letter to Barclaycard on 5th February requesting my charges be refunded within 14 days or I'll start proceedings. Have had a letter back today saying they are looking into it and will get back to me by the 6th March. SHould I wait or go ahead and send the second letter after the 14 days are up?
  • I wouldn't recommend estimating charges as if this comes to court you need to provide lists of your charges as your defence.

So what would you recommend if Barclaycard won't give me the information that I need?
  • Hi I have just recieved a letter from Barclaycard,
"Further to your request for copy statements,we are writing to inform you that the 40 day legal time limit for supplying this information is about to expire.
The reason for the delay in our providing this information is the very large number of identical requests that we have recieved, all of which are obliged to respond to in the same timescale.
We have made the Information Commissioner's Office aware of the volume challenges we face and that we are writing to you in these terms. We are sorry for the delay but assure you that we will let you have your statements as soon as we can.
We regret that we are not able to enter into correspondence with you about this issue."

    Is this a standard letter??
    Anyone else had one??
Oh and it just goes to show that they are either just trying to delay things or they are getting alot of people asking!!!
  • Sadly this seems to be a problem with Barclaycard and I don't know the answer to what to do other than report via ICO.
  • What was the standard Barlaycard fee from 2004 backwards, for late payment?
