I actually inserted the following paragraph in my SAR letter:
"I am aware that Barclaycard have previously refused to supply certain data on the grounds that records prior to May 2004 are not stored on a 'relevant filing system' as defined by the Act. I am also aware that the Information Commisioner has upheld complaints by Data Subjects regarding this issue and concluded that Barclaycard's microfiche files are indeed a relevant filing system. For this reason I will not accept any refusal to supply the requested data and I shall treat any such refusal as a contravention of the Data Protection Act."

I think that does the trick nicely, no more Barclaycard trying to wriggle out of their responsibilities under the act.0 -

RIGHT! I have joined the scores of people reclaiming illegal bank charges! My only target at present is Barclaycard, who I have always found to be sneaky, money-grabbing b****ds.
Has anyone else either initiatied or successfully completed claims specifically against BCard? I would be very happy to hear how you are getting / have got on.

Hi
I need some help I had to pay £135 to get my barclaycard statements as they were playing the goat with the microflim thing! I got a letter from the ICO barclaycard broke the 13th act etc etc I'm sure all of your who have this this letter tyhe ICO.
With this in mind I have sent barclaycard 3 letters asking for my £135 back but I have had no reply! (And yes they all wnet recorded delivery so I know they got them)
What I need is some help as I am going to go through the smalls claims court to get my money back. Also I beleive that I can claim compensation as well as they have broke this 13th act.
Can somone help me by putting a letter together for me please?

I wish I had the guts to go all the way. I know that I'd send the second letter then worry myself sick about it. I'm getting cocky now, gonna try Barclaycard. That's another account that's been closed for a few years. I've got nothing to lose by asking!

I've just received a letter from Barclaycard stating that due to the volume of requests received they will be unable to send my statements out within the 40 day limit.
They state they have informed the information commisioner of their predicament !
Should I complain to the IC or just sit tight, does anyone have any advice ?
PS. They never signed for my SAR even though it was sent recorded delivery !0 -
