This is a good example of why contact should be made by letter. You forget what was said and have no written record.
You need to find out whether you have accepted part of full payment. Ask for written confirmation of the refund. Sometimes they will also send you a letter to sign, so if you recieve this, read it carefully.0 -

after sending them the statements it didnt take too long, about 2 weeks for them to make me an offer. however, in the letter i got this morning they say "as a matter of goodwill, i'd like to reduce the fees we've added to your account to £12. I've refunded £80 and sent you a cheque for this amount."
!!! Does this mean i am not able to claim the full amount of £200+ because they have now reduced the past charges from £20 to £12? If i can claim the full amount then i will have to return their cheque with my refusal letter.
anyone know if this is correct? am i able to still claim the full amount i originally asked for or do i have to settle for the difference they have calculated?

The OFT said that any CC charge over £12 would be deemed unfair. They also said that just because this charge was set at this value, it did not make it fair or lawful (only a judge can decide). The CC companies are still not going to court to reveal their true costs.
I would personally return the cheque, and push on. It is an individual choice though that only you can make.How many surrealists does it take to change a lightbulb?

thanks for the info. i think i will at least send their cheque back along with the next 'i'll take you to court' letter. be just my luck to be the first case in court :-)0

I can't see a dedicated thread for Barclaycard on here.
I am about to start a claim on my Barclaycard account and would like to capture anyone's progress and experiences.
I have read in some threads that they are very awkward right from the Data Protection stage so think I might have a bit of a challenge with this one!!
I will keep this thread up to date with my progress with Barclaycard and any input from others will be gratefully received.
Right, off to the Post Office to post my SAR.

They are awkward - claim that certain statements are only held on microfiche so will cost you more. You can either just pay it and claim that back from them too or argue with them! If you follow the guide carefully, you shouldn't have a problem getting your money back.
Remember to stick to your timetable and don't allow them to delay you with excuses.
Carry out all correspondence by letter so you have a record. If you must speak to them on the phone for any reason, insist on a letter confirming what has been said.0 -

BarclayCard's claims that microfiche is not covered by the act has been overruled by the Information Commissioner.
If they try this one, come back and we will discuss how you can slap them down using extracts from the Information Commissioners letter.0 -
Earlier this month I tried to claim back a £20 late payment fee (not much I know) from Sep 2004 last month. But Barclaycard were having none of it. They wrote a letter back saying something along the lines of you were late making a payment so we are allowed to charge you £20. :mad:
Not too sure whether or not to take it any further? If anyone could give me some advice I would be most grateful.0 -

I would! It may not seem worth it for such a small amount but claiming it back helps show the banks that they can't walk all over you! Follow the steps listed here and go for it! Barclaycard are one of the companies who say that they'll refund you the £8 difference between the £12 general guideline charge and the £20 they actually charge, but say no and keep going."Think for yourselves and allow others the privilege to do so too."
