Hi I am new to this forum but not new to reclaiming charges.
I found out last Friday with Barclaycard the later you leave it to agree to settle your claim the more bargaining power it gives you as ultimately the Banks DO NOT want to meet you in court.
Here is the Lowdown on what happened with Barclaycard:-
Originally I was owed £744.00 that they took in late payment fees and overlimit fees.
They paid me £372.00
This left them owing me £372.00
I spent a little on my card and then I refused to pay them anymore monies due to the fact they still owed me money.
Then I filed my claim.
Since filing my claim they had accumulated a further £428.00 in charges on my account.
They then passed this on to MERCERS debt collection agency who have pestered me for months and threatened me with bailiffs and such (which I laughed at).
They also applied a default notice and showed late payments on my credit file.
Anyway my court date was set for Monday morning 26th Feb.
Last Friday morning I negotiated with Barclays Solicitor that I would settle out of court.
He was DESPERATE to speak to me as he didn't want to have to meet in the courtroom.
These were the terms:-
1. They will pay mercers the £428.00 and get them off my back.
2. That they remove the default notice and adverse credit history from my credit file.
3. They pay me the difference they still owe me from my original claim.
I recieved confirmation in writing this morning that all my demands have been met and my cheque is in the post.
This brings the total of my claiming of charges to around £6,500 now.
And I haven't even started on my wifes claims yet .
The interesting thing here is that in my original claim It was only for the £372.00 yet I managed to make them agree to meet all the other demands I had which occurred after the original claim.
Perhaps if you have had extra charges and defaults added to your credit file after your claim it might just pay for you to hold out until near the court date for maximum bargaining power.New to comping March 2008 wins so far:

Waahey just logged onto internet banking and Barclaycard have credited my halifax account with £80 reclaimed charges for an old barclaycard account. It's not a lot I know but its in my pocket not theirs.0

I sent my initial letter asking Barclaycard for list of charges on 7 Jan 07 and I didn't receive a letter from them before 5 Feb, where they were confirming receipt of my request and that copies would be sent to me within the 40 day legal time scale. I then received another letter by them on 19 Feb, where they were saying that they were dealing because they have received a very large number of identical requests.
Then they write 'We have made the Information Commisioner's Office aware of the volume challenges we face and that we are writing to you in these terms. We are sorry for the delay but assure you that we will let you have your statements as soon as we can. We are sorry that we are not able to enter into correspondence with you about this issue'
Still no answer ever since. What's that all about? Can I complain and to whom?

i just got the statements right on the 40 day deadline so they do come they just take time...If i upset you don't stress, never forget that god aint finished with me yet.0

Hmm. They have no record of my previous phone call on the 22nd Feb asking for my statements. Lets hope the Lovely Lisa that I spoke to tapped me into her PC this time!0

Sorry not had a chance to go through the entire thread as i'm tired. Has anyone got a copy of the amended letter for the credit card companies that we use as I can't find it.
