    Given todays article I have decided to add this line to above posted standard letter:

    "As we are both fully aware there is no valid reason to delay my request for data past the 40 day deadline and any deliberate delay in issuing this information will result in complaint to the Information Commissioner for which you may face prosecution."

    May not have any effect but it looks good and is factual :)

    i have had my barclaycard since jan2006. since then i have been charged £72 in late payment and admin charges, each one £12.

    i wrote to them to try and claim this back, they responded saying because none of the charges were over £12, they were just in doing so and would not return any of this money.

    is this correct?? as i know there was some guidline set out for credit card companies, saying that £12 is an appropriate amount. does this mean i can not claim any of my charges back???

    That is correct!

    I had sent my letter to BC on the 14th Feb and received a reply today telling me that my statement request will be dealt with within the 40 day deadline. Roll on 40 days....

    I don't seem to be getting anywhere with Barclaycard! :mad:

    Sent them a letter requesting my statements for an account I used to have with them.

    Sent them an email last week to check that they received my letter as I still hadn't received a letter of acknowledgement or anything. Got an email back saying phone this number (the normal god knows how much a minute number).

    Emailed back saying I only wanted them to confirm they had received my letter and I would prefer to deal with them in writing. Reply from them was they don't do that :confused: Made me angry but also made me laugh!

    Anyway the 40 days is up next Monday so lets hope they get their bum's into gear or they will getting another complaint!

    Sent off my letter today requesting a breakdown of charges for my Barclaycard. Will be grateful for anything from them and certainly have a reputation for dragging their heels. I am crossing my fingers...
    THE LONG AND THE SLOW ROAD SEEM TO APPLY TO DEBTS AND DIETS... THE TWO THINGS I WANT TO SEE THE BACK OF...:D

    You have still not complied with my Data Protection Act Subject Access Request dated 01/02/2007.

    If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. I will also forward copies of my requests to the Information Commissioner.

    I look forward to your timely response.

    Hi all

    I had a capital one credit card which i paid off in 2004, i thought i would request my statements from them (which they provided for free! by the way i phoned up using the number somewhere on this forum.)

    when i received them, i was stunned to see that i only had a credit limit of £100.

    when i tallied up the unlawful, extortionate, crippling...etc charges, it came to over £1000!!

    letter sent immediately to recoup the theft of my dosh!
    look out capital one, you are not the first to feel my wrath and you won't be the last!!!


    Abbey--- claiming £3688, stage: just submitted court papers after ridiculous non responsiveness

    Capital one--- Claiming £1207.18 (inclusive of int)

    Barclaycard--- sent statement request on 13 feb, still waiting for them


    good luck all, and don't worry about the OFT ruling due out soon
