That's interesting - I had a letter today saying more or less the same thing, but which did include all the statements since I opened the account - Letter basically said that they were very put out about being asked to look through their microfiche records and it wasn't covered by the DPA but they had done so out of the goodness of their hearts etc...
Load of rubbish and they're bloody lucky it arrived today too as the deadline for them to reply was actually monday, only reason I hadn't contacted the Data Commissioner yet was because I've been busy all week!:p
Anyway, I'll be chasing them for just under £730 now!:eek:0 -

I sent off a cheque to Barclays 2 weeks ago asking for my 6 years statements, i have received them today but only from June 2004 as any statements after this date are stored on micro film, they go on to say that the information for my statements before that date will be sent out to me but could take up to 6 weeks.From the June 04 statement i was £152.80 over my credit limit, so i am asking if i should wait for those statements to come or do i base the remainder on the charges for the rest of that year?????0 -
Hi - I'm wondering if anyone can give me some advice?
I have my statements from Barclaycard (eventually), and have totalled them up to £640 (£730 with interest).
However - My account is currently over its limit and has been passed to a debt collection agency. I have stopped making repayments to either them or Barclaycard until this gets sorted out, because I'm not prepared to repay money which I don't owe.
The agency are aware of this, because I spoke to someone last week and explained the situation. However, this means that I have not actually paid the last few charge applied to my account.
SO, do I simply ask for all the unlawful charges to be removed from my account (which would leave me owing about £60, which I'd then repay) or do I press ahead through the same route as I am using to challenge bank charges?
I'm just worried that they could enter a defence that I've not actually paid some of the charges I'm reclaiming, and this would invalidate my whole claim including for the ones I have already paid?
Sorry for this being a bit confusing! Any advice would be much appreciated!0 -
BTW I have just calculated the charges i have received from June 2004 - present = £1175.69. I am just wondering if it's worth waiting up to 6 weeks, admitidely it could boost my figures up by a couple of hundred pounds or do i just ask for the figure i have, any suggestions please would be gratefully appreciated.0

I would suggest that witholding payment on the basis of your complaint about charges is probably not a good idea. It is far better to keep up payments and claim back afterwards. You could be seriously affecting your credit record and may finally incurr a default if you make no payment at all.
However, when you do claim, if there are charges on the account you haven't yet paid just exclude them from your total - just include charges you have already paid and ask for the unpaid charges to be withdrawn.
Do remember that this process can take some time and that if you withold payment throughout you could find yourself in a sticky situation, and as you say they may see this as an opportunity to defend.

Hi. i had exactly the same problem, write to trhem again, explaining you never asked for statements, merely information, and that if this is not supplied you will contact the OFT and Financial Obsubmem.
I eventually got my info, been fighting them since Sept last year, not near any settlement. xxx rip dad... we had our ups and downs but we’re always be family xx0 -

in exaxtly the same boat as well, Barclaycard offered me the difference back, but only if they could credit it to my account!

Hi guys
I'm 24 yrs old and have had a barclaycard for for a few years now (19.9%) Purchase Annual Rate, (27.9%) Cash Annual Rate.
My original credit limit was £400, however after a few late payments this was reduced to £260.
I was charged a £20 late fee plus interest - and my original minimum payent of around £6 a month rose to around £30.I couldn't keep up, and i went over the £260 limit - another £20 over the limit fee, and then £20 late charge.
This escalated to a balance of around £500 - ALL FROM CHARGES for being over the limit, and then being late. I tried paying, often paying in sums of £20 to try and keep up, but I was being charged £40 a month as "new transactions" for late and over the limit fees. I eventually paid in £300 and the balance remitted to around £250.
However, i went over the £260 limit soon after (I pay in person, can't afford a direct debit) and again got hit with £40 charges, and over the last few months the balance has again risen to around £400, ALL in charges, or these so called "new transactions".
I find this proposterous, as the only actual transactions I ever made were online to around the sum of £50-60 pounds over a year ago!!
I estimate I've already paid around £500 in charges on that original £50-60 I spent. My question is, can I reclaim any money? These charges hardly seem proportional to the "costs" incurred. I've read the section on reclaiming charges, however that seemed mainly concerned with much larger debts than these. I desperately need this money for medication for a long term illness and really appreciate any advice. I haven't used this card in well over a year (in fact I cut it in two) and am now getting aggressive calls from Mercers. Barclaycard is also asking for a minimum payent of around £140, an impossible amount for me. I'm also getting charged around £7-8 pounds a month interest on these "new transactions". This stress is seriously exacerbating my illness (U. colitis).
