Help anyone
I have claimed on behalf of my son for about £150. They have since credited his account with half £75. Now the time is up today so we could now file a MCOL for full amount. Does anyone think this is worth it, will we get the whole amount back??0 -
Sent my letter off to Barclaycard a week ago. Rec'd reply today saying they are looking into my complaint and aim to resolve matters by 10th april. Don't know whether to wait till 14 days are up i.e. in a weeks time and send next letter or to wait till 10th April and then send next letter. Anyone been in this situation with them or can give any advice please0

Stick to your own timescales - if they haven't replied to you in that time just carry on to the next step0 -
Hi , Me again, it gets worse, after delay tactics I wrote as suggested to Barclycard saying i had reported them to Commission and also sent copies of complaint form to Barclaycard with letter saying response please with in 14 days , and guess what ZERO.No statements no idea what to do next!!! very frustrated as it appears some people are getting results and I have followed the plot to the letter and all dates.0

I have just recieved copies of my credit card statements and after reading these threads have gotten an exact letter like everyone else. They can only send me copies from June 2004 (glad to see we`re all the same)but the rest of the info stored on microfilm will be sent to me but could take up to 6 weeks or so !! Also they are doing this as a gesture of goodwill, pity they didn`t have such goodwill when l first paid a late payment and got charged and asked them to reconsider, never mind . Its taken a fortnight for these to come so hopefully l should recieve the rest soon and they haven`t cashed the cheque yet !!0

Give up with Barclaycard.
Had a letter off them dated 2nd March, got on 6th, stateing that they dont believe in the legal arguement that I used, my claim+ interest £450.00, they offered me £119.00 as a goodwill gesture, but only if I have it credited to my account.
No way, the air was blue, steam coming out of my ears, wrote back saying no, pay up or else!! That was the just of it. Checked my statement 2ngt, theyve only gone and credtied the £119.00 on to my account, beggers belief, but Im sticking to my guns, they have until the 23rd March, so fingers crossed!:Axx rip dad... we had our ups and downs but we’re always be family xx0 -
I sent a letter to Barclaycard on the 6th of March asking for my statments to be sent to me, this morning I recieved the following letter.....
Dear XXXXX
Further to your request for copies of your credit card statements we are writing to you to let you know about two things; firstly to enclose part of the information you have requested and secondly to explain the position with regard to the other statements you asked for.
Enclosed you will find copies of your credit card statements from June 2004 to the present time. These statements are stored on computer. We will be sending your statements prior to this date later. These later statements are stored on microfilm rather than computer and, take more time to search and reproduce. We will get this information to you as soon as we can. This is likely to be within the next 6 weeks or so.
Statement requests are being processes in the order in which they have been received to seek to ensure fairness. The data protection regulator, the information commissioner, has been made aware of the position and knows that we are writing to you in these terms. The information commissioner is also aware that whilst endeavouring to supply this information as quickly as we can we do not consider that the microfilm statements fall within the scope of the data protection act 1998. Nevertheless we are happy to provide these as a gesture of goodwill.
This information is complete in relation to your account at the time this information was drawn to it.
I have read through numerous threads on this sita and can see that the claim that microfilm isnt covered by the DPA is not accurate, and even though they say I should be sent the rest of the information I asked for within 6 weeks at the outside it will be 52 days, well outside the 40 as set out in the DPA.
Would it be worth sending a letter to them saying that I expect to have the rest of the information within the original 40 days or should I sit tight and wait?0 -

I would wait until the full 40 days is up. If you haven't received the rest of your statements in this time send the following letter which has previously been suggested by someone on this site (can't remember who):
ACCOUNT NUMBER XXXXXXXX
I sent a letter and £10 cheque on the [insert date of first request] requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.
I look forward to your timely response.
Find enclosed a copy of my original letter.
Just reword it slightly to explain you have received some statements but are still waiting for others0
